Newark man arrested, charged with committing sex crimes on patient at Fremont facility

A Newark man has been arrested and charged with 17 felony counts of committing a sex crime on a dependent adult while being a caretaker, according to authorities.  The caregiver is accused of committing the crime each week between April 1 and Aug. 23, court documents said.

Lodi police arrested a 48-year-old woman on Thursday on suspicion of stealing more than $20,000 over the course of at least a year from an elderly woman, authorities said.  According to Police Sgt. Eric Versteeg, Serpico befriended a 90-year-old woman and offered her rides to the grocery store, doctor appointments and other locations using multiple tactics to withdraw funds from the victim's account.

A Monterey County judge has ruled that a woman who took cash and property from an elderly Seaside woman committed financial elder abuse and must pay back more than half a million dollars to the victim, who is now under the conservatorship of the Monterey County Public Guardian.

A South Bay real estate broker was arraigned Monday on charges he embezzled more than $10,000 from a 78-year-old relative in San Rafael.  The 44-year-old Gilroy man is charged with nine felony counts including perjury, forgery, burglary, identity theft and identity theft from an elder or dependent adult.

Deadly neglect at some San Diego County assisted living facilities

Out of 18 deaths that the state did investigate and judge preventable in San Diego County since 2008, 12 were subject to a fine. It was $150, the maximum allowed by law.  At least 196 deaths considered to be accidental in assisted living homes since 2009 have been reviewed by San Diego County’s medical examiner, according to reporters’ analysis.  The examiner is not required to notify the state Department of Social Services of its findings, and the department’s inspectors do not monitor its reports, meaning that suspicious deaths may fall through the cracks, with a resident’s survivors not even knowing the facts.

In a case of suspected elder abuse to a 95-year-old woman that led to death in 2006, the family still struggles with getting the proper agencies to investigate this case.  The article states that from 2004 to 2008, public health regulators piled up more than 900 cases in Southern California; cases that involved severe injuries and suspicious deaths.

Author states that California regulators routinely conduct cursory and indifferent investigations into suspected violence and misconduct committed by hundreds of nursing assistants and in-home health aides – putting the elderly, sick and disabled at risk over the past decade.  In 2009, the state Department of Public Health quietly ordered its investigators to dismiss nearly 1,000 pending cases of abuse and theft after officials determined their swelling backlog had become a crisis.

Sweetheart swindle-case of elder abuse

Attorneys in a financial elder abuse case calculated that a woman pretending to be in love with the elderly man took “about $53,000 over a period of nearly 3 years”.  On August 15, 2013, nearly two years after the 82-year-old man had been laid to rest, the jury found in favor of the plaintiff on all counts. It was a 70 thousand dollar verdict - including 10 thousand dollars in punitive damages.

An Ainsworth man’s 2011 convictions on involuntary manslaughter, theft and dependent adult abuse charges will stand following a court opinion released this week.  Rodney Lee Bean, 54, is serving a 17-year prison sentence after a jury found him guilty for his role in the 2008 death of Joye Gentzler, 79.  Gentzler, who weighed just 74 pounds at the time of her death, died from malnutrition and dehydration.

Five of the wounds were so deep that bones were exposed.  At the hearing, the defendant said that her father, who had suffered three strokes, told her he was ready to die. He refused food, she said, and she heeded his wish.

A second jury trial seeking damages from Grand Forks County over alleged misdeeds by the county’s former public administrator is set to begin today, 11 days after a similar lawsuit ended with no financial damages assigned to the county.  The attorney argues that the defendant was a county employee, making the county liable for her failure to do her duty as public administrator, including accounting for the victim’s estate.

Cole Elf, 28, of Bend, admitted he stole 40 prescription painkillers from a handful of residents at the Touchmark at Mt. Bachelor Village retirement community, according to a police report.  Elf was arrested and charged with unlawful possession of oxycodone and a schedule II controlled substance, both of which are felonies, as well as unlawful possession of hydrocodone and third-degree theft, which are misdemeanors.

Car salesman, Millersburg woman allegedly caught stealing from the elderly in Dauphin County

A 53-year-old a car salesman was arrested after he allegedly falsified bank loan applications for two county residents through the Pennsylvania State Employees Credit Union and profited from the loans, authorities said.  Also, a 50-year-old Millersburg woman allegedly used her power-of-attorney agreement to steal from an elderly relative’s estate. Police said she stole $10,506 from an 86-year-old woman and used the money for “nonessential items for her own personal use.”

Three former CNAs who admitted spraying two Appalachian Christian Village nursing home patients with water to agitate them were denied judicial diversion, but won’t serve any jail time.  A fourth woman was granted diversion because she didn’t participate in the abuse. She was charged because even though she didn’t participate, she saw the abuse on one occasion and didn’t report it.

An 86-year-old woman diagnosed with dementia was scammed out of $50,000 dollars by a man who claimed to be a landscaper, and the woman isn't the only one to be fooled, prosecutors say.  Victim’s son recently was appointed power-of-attorney for his mother after she had surgery, and noticed his mother had written several large checks to "Dayton's Landscaping" over the course of a year.

An 82-year-old dementia patient lay for hours on the floor after a fall because other emergency calls in the area were prioritized over his.  Care home manager Fay Cameron said ambulances normally arrive at Marple Lodge within five minutes of calling them and it was the policy of the home not to move people who had suffered a fall before medical experts had examined them.

Eric Deroian, of the Burbank Police Department.

A 78-year-old Wells Fargo client supplied scam artists with his wife’s personal information and also sent $88,000 thinking he had hit the jackpot.  The bank stopped the “last payment” of $50,000 to be transferred, persuading the client’s family to get involved.

Decrease in antipsychotic drugs for dementia patients in nursing homes hailed by CMS

Linda Foss, 62, the former president of the Montclair Village Association, entered guilty pleas in Alameda County Superior Court to five counts of elder theft, two counts of grand theft and one count of money laundering.

According to Lee’s attorney, in 2007, Pinkus tricked the author into signing over royalties from her best-selling book after suffering a dilating stroke.

She initially asked a relative to record a mess her husband made on July 25, which showed the suspect slapping, beating and verbally abusing the 65-year-old man, the report said. The relative showed the video to a counselor. It was then handed over to the Sheriff’s Office.

The Health Care Oversight Committee reviewed three months worth of statistics on reports of elder abuse in the state that are filed with the Adult Protective Services (APS) division of the Department of Aging and Independent Living (DAIL). In the past, APS has struggled to investigate reports of elder abuse in an adequate and timely manner. Concerned by backlogs and the unusually low number of allegations that are substantiated, lawmakers asked for a number of changes to the program, including more information on a more frequent basis.

Officers tried to revive the woman but were unsuccessful, Raman said. Her name was not immediately released.

In the first decade of this century, the number of elderly Washington residents living with Alzheimer's disease increased by a third. That number is expected to balloon by a third again by 2025. Crucially, 6 in every 10 of those diagnosed with Alzheimer's, and many with other forms of dementia, will wander or get lost, placing themselves and sometimes others at risk, according to the Alzheimer's Association. Washington is one of just six states that haven't started work on a statewide Alzheimer's plan, even as the population at risk of wandering surges.

Nearly two dozen people who failed criminal background checks were allowed to work with developmentally disabled clients in Washington state, according to a state audit released Wednesday. In conflict with state policy, some businesses hired the 23 caregivers even though they had past legal problems involving assault, theft, drug charges, abuse and financial exploitation, according to the audit. Officials said it wasn't clear whether the caregivers had unsupervised access to the clients -something that would violate state law - but assumed it happened in some cases within the supported living program.

Attorney General Luther Strange's office says that a former Etowah County nursing home employee has been arrested for allegedly assaulting a resident. The suspect, 44, of Altoona, was arrested July 24 and has been released on bond. The suspect has been indicted for abusing a protected person, which is a class C felony. The alleged abuse took place Dec. 26, 2012. If the suspect is convicted of the crime, he could face up to 10 years in prison and up to $15,000 in fines.

The suspect was held on $15,000 bail for grand larceny and criminal possession of stolen property charges. The victim was diagnosed with dementia and Alzheimer’s disease. If convicted, the suspect faces up to 15 years in prison.

During that time, the suspect wrote and cashed approximately 180 checks totaling approximately $500,000 from the victim’s bank account, according to court documents.

Research nationally and in Tennessee shows that elders and the disabled are increasingly victims of financial exploitation and that much of the time it is family or close friends committing the abuse. A 2009 study by the National Center on Elder Abuse showed 90 percent of overall elder abuse — physical, sexual, financial — was committed by family members.

A 93-year-old woman living outside her home due to her son’s hoarding and neglect is back with family and doing well. Tines Sosa's house was overrun with trash, tires, 22 mattresses and multiple couches that, she says, her son kept dropping off at the house. After the story of her poor living conditions spread, volunteers flooded the property to clean it up. For two days, people hauled trash to the landfill and brought food and water to the home.

Monona Police have arrested a 25-year-old Rio woman after she alleged exploited a 93-year-old man. The suspect was arrested for two felony charges of theft for financially exploiting an elder, misdemeanor damage to property and two misdemeanor counts of bail jumping. Police say the suspect met the victim in the Monona Walgreens parking lot, and told him she was having problems with her car and needed gas money. Officers say over two days, the suspect obtained more than $1,000 from the man. She also allegedly used his vehicle during that time.

One in three cases of elder abuse reported to the Health Service Executive last year occurred in the South, with sons and daughters cited as the alleged perpetrators in nearly half of cases. The HSE South, comprised of Cork, Kerry, South Tipperary, Carlow, Kilkenny, Wexford and Waterford, saw 902 referrals last year, the highest of any region across the country. In total, there were 2,460 referrals made to the nationwide service in 2012, an increase of 7% from data from the same time-point in 2011. In the South, there was a rise of 13% in referrals for the same period.

The Brothers of Charity in Waterford has revealed details of three sexual assault allegations made by adults with special needs against two of its former employees. The incidents took place in the 1990s, but they did not come to light until last year.  Blame was directed at two former employees. One is dead and the other left the service in 1994.

A Las Vegas woman has been arrested on a count of murder after she forced her mentally disabled son to overdose on prescription medication but survived an attempt to kill herself, Metro Police alleged. The woman told police that she wanted to kill herself but was concerned that her son, who required constant supervision, could not take care of himself, so she decided to end both of their lives.

A developmentally disabled young man who died in a hot SUV outside his group home Thursday had the happy, mischievous mind of a toddler, according to the CEO of Cherry Tree Residential Services.  The young man was identified Friday as Terrance Sanders. Officers were called to the group home, which cares for people with special needs where Sanders lived after an employee of the home found the man unresponsive in the Honda CRV. Sanders was deceased when police arrived.
