Effective January 1, caretakers of seniors living in nursing homes and assisted living facilities are required to report suspected abuse to both the care center's ombudsman and a law enforcement agency. AB40 doubles mandated reporter duties to share knowledge or suspicion of physical abuse, abandonment, neglect, isolation or financial abuse of residents in long-term care facilities.

Laws already on the books mandated caregivers report suspected elder abuse, but a new law changed who they report it to and how quickly they do it. Those in California required to report suspected elder abuse now need to call law enforcement officials in additions to the ombudsmen’s office, which are patient advocates.

Jury finds Newbury Park couple guilty of elder abuse in civil case

A Newbury Park couple found liable for elder abuse may be ordered to give up their home and pay more than $30,000 in damages when they face a judge next week. The couple were sued in civil court in 2011 by the woman’s mother, an 88-year-old woman, for buying a home in Newbury Park with the mother’s money and refusing the put the home in her name. A jury on Dec. 19 found the couple liable for elder abuse and awarded the woman’s mother the house, worth about $500,000, in addition to $25,000 for emotional suffering, $9,000 for economic damages, and attorney’s fees.

A recent study suggests that physical changes in our brains as we age could explain why elderly people fall for scams more often than the rest of us. The study by UCLA researchers found that older people had more trouble picking up on visual cues in the faces of people trying to scam them. MRIs showed that a part of the brain called the anterior insula had less activity in older people confronted by untrustworthy faces than the same part of the brain in younger people did.

Dementia Postcode Lottery: Alzheimer’s Sufferers Denied Access To Treatment

In some areas of the UK as few as one in three people suffering dementia will receive a formal diagnosis, while in other areas three quarters of sufferers will be told by a doctor about their condition, according to data released by The Alzheimer's Society. Across the UK just 46% of sufferers were diagnosed in 2012, the society said. Health Secretary Jeremy Hunt said the country should be "ashamed" that so many people were being denied treatment which could stave off the condition for years. He said that doctors are refusing to carry out tests for dementia as they believe it is pointless as there is no effective cure available.

A young woman convicted of conspiring to beat up and rob a disabled Mount Pearl man has been sentenced to nine months in open custody and time served. She was one of five people arrested after the disabled man, who is in his early 20s, was lured outside and robbed near Mount Pearl Square in September 2012. After the assault, she sent a text message saying: "I broke his nose and split open his face. Ha, ha ... I f**ked him up."

A disabled pensioner stabbed to death on his own doorstep lost almost a third of his blood, a court has heard. Peter Lewis, 68, a man who also had learning difficulties, made a dying desperate call for help saying he was “bleeding terribly” and begging for someone to come and bandage his wound. The suspect is a man who claims he got into an altercation with Lewis as he walked the neighborhood searching for drugs.

Disabled people ‘missing out on basic needs’ in social care

The BBC has learned that there has been a rise of nearly 70% in the number of people with disabilities seeking help from Citizens Advice Bureaux. The figures come as leading charities claim there's a £1.2bn funding hole in the budget for social care for people with disabilities living in England. They also claim that more than a third of people with disabilities in England aren't getting enough support with their basic needs like washing, dressing or eating.

A local woman who suffers from dementia was reported missing on Wednesday after wandering away from her care home. She was located later that night and was taken to the hospital due to a fall.

Disabled New Market man, forced from theater, dies

The Frederick County Bureau of Investigation and the Maryland Office of the Chief Medical Examiner are investigating the death of Robert E. Saylor, 26. Saylor had Down Syndrome and had refused to leave a theater after watching a movie. A theater employee asked off-duty deputies to help remove the man. The deputies handcuffed the man, who suffered a medical emergency in the theater, and was later pronounced dead at Frederick Memorial Hospital. The cause of death has not been determined.

- The American Bar Association has announced a further round of grants to be made in 2013 that will promote and support innovation in the delivery of civil legal aid. These grants will go to the state Access to Justice Commissions. The grants will fund projects in seven critical areas of innovation: expanding limited scope representation and other models for affordable services; improving language access and eliminating implicit cultural bias; employing public libraries as point of access for legal aid; enhancing fundraising outside the legal community; creating partnerships with health care and social services providers, government agencies and other new partners; preserving access for low-income people as courts implement e-filing; and increasing web-based delivery of pro bono services for self-represented litigants. Eligible entities are state Access to Justice Commissions, which are formal entities that bring together the highest level of the state's courts, organized bar, and other stakeholders to support the expansion of access to civil justice for low income and disadvantaged people. Applications for Grants to Promote the Creation of new Access to Justice Commissions are due by February 15, 2013; applications for Innovation Grants are due on May 1, 2013.
