A Newbury Park Financial Planner was arrested today for Financial Elder Abuse and Money Laundering following the execution of a search warrant at his business and home. The suspect allegedly embezzled money from an 89-year-old victim. Suspicions were reported to police by a concerned family member.

A bill requiring people in certain occupations ranging from medical care to the clergy to report abuse of seniors cleared a Colorado Senate committee on Wednesday. Senate Bill 111 is the product of an elder abuse task force that met last year to make recommendations on legislation requiring mandatory reporting of elder abuse. Colorado is one of only three states that does not have such a law.

The Colorado State Senate Judiciary committee passed a bill today that would make it mandatory to report the abuse of elders. If the bill passes through the entire state Senate, certain individuals would be required to report to law enforcement whenever they suspect abuse, neglect, and/or exploitation of any elder 70 or older. Colorado is only one of three states that does not enforce the mandatory reporting of elder mistreatment.

Anastacia Oluoch, the woman accused in the abuse of a 90-year-old Baltimore man, has pled guilty to three counts of the abuse of a vulnerable adult and received a six-year sentence for her crimes. A brutal attack on the victim was filmed by the victim’s daughter. The Oluoch initially fled to Kenya, but with the help of federal authorities, Baltimore Police extradited Oluoch back to the U.S. so she could stand trial.

For the second time in less than a month, state officials have found evidence of neglect by a nursing home worker who failed to try to save a patient who was in distress and died. In the latest case, a staffer at a Minneapolis nursing home did not administer cardiopulmonary resuscitation (CPR) after being called to the resident’s room by employees who saw the man, who could not talk, “blink and take a last deep breath,” according to the report released Tuesday detailing the death at Benedictine Health Center on the southern edge of downtown.

Senate Bill 134 would revise portions of the existing Montana Elder Abuse Prevention Act, making it easier for prosecutors to use it in elder abuse cases. Specifically, it would eliminate the need for prosecutors to prove the victim’s capacity due to mental or physical impairment and clarifies that the definition of an older person is anyone over the age of 60. The bill also creates a mandatory minimum prison sentence of one year or a fine of $50,000, if a criminal financially exploits a senior and steals more than $25,000.

Ohio Attorney General Mike DeWine joined State Representatives Mike Dovilla (R-Berea) and Wes Retherford (R-Hamilton) Thursday to announce that they will push for passage of the Ohio Elder Justice Act, legislation designed protect older Ohioans from abuse and financial exploitation. House Bill 49 is intended to strengthen the existing Adult Protective Services Law and will improve the response to elder abuse incidents and encourage reporting of elder abuse cases.

A Norwalk man found guilty by a jury in November of raping a mentally impaired woman was sentenced Tuesday to serve eight years in prison and 35 years of probation. After two days of deliberation following a two-week trial, a jury found the man guilty of second-degree sexual assault by virtue that the woman, who was 20 years old at the time, was mentally defective to the extent that she was unable to consent to sexual intercourse.

The mother of a young Augusta man whose badly decomposed remains were found in her home last fall has been indicted on a charge of murder. The woman, who was her son’s caretaker, was arrested on a charge of concealing a death after the body of her 23-year-old son was found in the family’s home. Because of the body’s condition, the coroner was unable to pinpoint the exact time of death.

Three sheriff's deputies from Frederick County, Maryland, have been placed on administrative leave following the suffocation of a mentally disabled man, a death that has been ruled a homicide. The 26-year-old man with Down syndrome had refused to leave a local theater after watching a movie and was forcibly removed by police. While in custody, he was placed face down on the ground and became distressed. The Chief Medical Examiner ruled the cause of death as asphyxia and the manner of death as homicide.

If passed, new legislation may change the eligibility of certain counties as venues for cases when a vulnerable adult is financially exploited. Currently, the criminal case must be tried in the county the offense was committed. The bill would also allow such offenses to be aggregated over a six-month period. Passed 122-0 by the House Monday, it now goes to the Senate where Sen. Barb Goodwin (DFL-Columbia Heights) is the sponsor.

- The American Bar Association has announced a further round of grants to be made in 2013 that will promote and support innovation in the delivery of civil legal aid. These grants will go to the state Access to Justice Commissions. The grants will fund projects in seven critical areas of innovation: expanding limited scope representation and other models for affordable services; improving language access and eliminating implicit cultural bias; employing public libraries as point of access for legal aid; enhancing fundraising outside the legal community; creating partnerships with health care and social services providers, government agencies and other new partners; preserving access for low-income people as courts implement e-filing; and increasing web-based delivery of pro bono services for self-represented litigants. Eligible entities are state Access to Justice Commissions, which are formal entities that bring together the highest level of the state's courts, organized bar, and other stakeholders to support the expansion of access to civil justice for low income and disadvantaged people. Applications for Grants to Promote the Creation of new Access to Justice Commissions are due by February 15, 2013; applications for Innovation Grants are due on May 1, 2013.
