Insurers with ties to OneWest Bank "exacerbated the foreclosure crisis" and abused elders by forcing struggling homeowners to pay sky-high costs for force-placed insurance products, a class action claims in Superior Court. Lead plaintiff Geraldine Doyle seeks class damages for breach of contract, unjust enrichment, breach of fiduciary duty, financial elder abuse, tortious interference and other counts.

Elder Fraud Trial Delayed

The trial for a man accused of taking advantage of elderly people in Redwood City was delayed on Friday, after the defense attorney failed to appear in court. The suspect in this case is accused of taking more than $270,000 from elderly people in the form of loans that he has not repaid. His victims were 51-88 years of age. None of the loans have been repaid.

Gov. Neil Abercrombie signed Senate Bill 102 to amend a section in the Hawai`i Revised Statutes relating to the reporting of elderly financial abuse. The most significant change is for financial institutions to report possible abuse to state human services as well as county police. The original statute required reports only to human services. Immediately after receiving a report, police must begin a criminal investigation.

A Nebraska woman accused of stealing more than $150,000 from an elderly Iowa woman has reached a plea deal. Terry Lockie pleaded guilty Monday in Woodbury County District Court to one count of dependent adult abuse. A first-degree theft charge has been dismissed. The plea agreement means a five-year prison sentence has been suspended and the 65-year-old Lockie will be on probation for two years. Her attorney says Lockie may also lose her certified public accountant license.

An Austin pastor has been charged with stealing over $40,000 from an elderly woman suffering from dementia. On Wednesday, police charged the suspect of Austin Church of Christ (Christian) with four felony counts of financially exploiting a vulnerable adult after he and his wife allegedly befriended an 82-year-old elderly woman suffering from dementia years ago and later became her power of attorney.

An Austin pastor faces four felony charges after allegedly bilking an 82-year-old woman with dementia out of more than $40,000. The suspect was charged Wednesday in Mower County District Court with four counts of financial exploitation of a vulnerable adult. An Austin pastor is charged with bilking more than $40,000 from an elderly woman with dementia. Authorities say suspect was the woman's power of attorney. A criminal complaint, in part, says the suspect used a $5,000 check from the woman to replace his furnace and claimed a $3,000 bank transfer to his account for a bowling trip was a reward for his care.

A 70-year-old Petal woman has been arrested on one count of exploitation of a vulnerable adult. Investigators allege the suspect signed papers naming herself to have Power of Attorney over the affairs of an elderly woman who was diagnosed with Alzheimer's, and subsequently took money that was intended for the victim. If convicted the suspect faces up to 10 years in prison and a $10,000 fine.

Abuse complaints in Ohio nursing homes nearly doubled so far this year compared with 2012, with 63 new cases filed in just the past month, according to Ohio Attorney General Mike DeWine. Mr. DeWine said his office’s Medicaid Fraud Control Unit has opened 131 cases to investigate abuse and neglect allegations at Ohio nursing homes in 2013, compared with 74 cases during the same period last year.

On June 18, U.S. Sen. Bob Casey, D-Pa., introduced the Senior Investor Protections Enhancement Act of 2013, which would impose higher penalties for fraudulent investments involving people 62 and older. At present, fines range from $5,000 to $100,000 for individuals and $50,000 to $500,000 for businesses found guilty of civil penalties. Under Mr. Casey's proposal, fines in civil suits would top out at $150,000 for individuals and $550,000 for businesses if the fraud involved seniors.

Rhiana Prince, who attends school in Oak Ridge, was one of the many students who participated in the local organization’s contest. Prince recently visited the Anderson County Courthouse in Clinton to be recognized by Anderson County Mayor Terry Frank.

Hundreds of maggots eating away at an obese elderly woman’s dead skin may have kept her alive, slowing an infection allegedly coming after days of neglect from her caretaker. According to court documents, the 70-year-old woman’s daughter faces felony elder-abuse charges after King County sheriff’s deputies found the elder woman stuck to the bedding in her home, with maggots eating at an open wound and bed sheets “soiled with the byproducts of injury and covered in bugs.”

There will be no speedy resolution in the case of a Wonewoc woman charged last year with abuse of a patient at a New Lisbon nursing home. The suspect is charged with intentional abuse causing bodily harm and aggravated battery of an 86-year-old patient at Crest View Nursing Home in New Lisbon between October 2011 and June 2012.

A man who spoke out against an alleged instance of elder abuse has died. Calvin Courtoreille, 82, was a resident of Jubilee Lodge. He was admitted to the University Hospital of Northern B.C. in January with kidney problems. According to his niece, Leona Esau, his wife and three children were by his side when he passed Wednesday afternoon.

Sheriff's investigators arrested a Pass Christian man Friday on a charge of sexual battery of a vulnerable adult. Officials said deputies went to a home on Katie Drive in response to a domestic argument and learned several family members had confronted a 59-year-old man with accusations. The man is accused of having sexual contact with a 30-year-old woman who is mentally impaired.

Officials say they have located a 74-year-old man who went missing Friday afternoon. Paris Police issued a Golden Alert for Palmer Hall on Friday. Hall went missing around 3 p.m. Friday, after he got into his 1990 Oldsmobile Silhouette van and drove away from home. Police say Hall was diagnosed with dementia in April, and had been living with family members since then. He's originally from Floyd County.

A 61-year-old man reported missing earlier today was found in Norfolk. Ashby C. Edwards III was last seen about 11 a.m. in the 300 block of Lynn Shores Drive and had abandoned his wheelchair, according to a Virginia Beach police spokeswoman. He suffers from dementia, respiratory failure and periods of confusion. He was reported missing about 2:30 p.m.
