On March 15, The Yavapai County Sheriff's Office deputies were dispatched to a married couple in Congress, on a report they were involved in a fraud. The husband and wife, both in their 90s, were in good health but readily admitted to deputies they had been "taken advantage of" resulting in loss of several thousand dollars.

One bill would raise penalties for business non-compliance of unsolicited phone intrusions and include text-messaging in the current Do Not Call law. It would also increase consumers’ awareness of how to make complaints of violations on phone bills.

A Boynton Beach man defrauded two older Delray Beach women out of more than $250,000 by writing false checks and then cashing them, police say. Roger Lavoie, 60, was arrested Wednesday for writing checks from the accounts of the women, who hired him as a financial adviser, and cashing the checks for his own gain.

Authorities on Tuesday arrested a man who had been on the Athens-Clarke County Police Department’s “Most Wanted” list for his alleged involvement in a series of crimes that include theft, fraud and elder abuse. Brudon was placed on the police department’s “Most Wanted” list in August 2012 after he jumped bail.

The Iowa House has approved the creation of a new crime of financial exploitation of a vulnerable elder in a scaled back version of elder-abuse legislation that previously passed the state Senate. The House version of Senate File 2239 makes financially exploiting vulnerable adults who are age 65 or older and unable to protect themselves a crime ranging from a simple misdemeanor up to a class C felony punishable by 10 years in prison. The penalty would depend on the dollar value of the exploitation.

Police officer named heir disputed dementia diagnosis

The same day Geraldine Webber was diagnosed at the local hospital as having mild dementia and being in need of a guardian, a police officer now accused of financially exploiting her radioed police headquarters to say that Webber "does not have dementia." The officer, Sgt. Aaron Goodwin, is the primary beneficiary of Webber's estate with an estimated value of $2 million. Her estate is being contested in the county probate court by multiple parties who allege Webber was incompetent when she endorsed a new will and trust to largely benefit Goodwin and that she was unduly influenced by him.

The Atlantic County Surrogate’s Office is looking into its records after a former court-appointed guardian was charged with stealing millions from seniors. So far, the Attorney General’s Office has said 10 people in their 80s and 90s were robbed by Lieberman with the help of former Atlantic County Adult Protective Services worker.

Mother, 90, in elder abuse case against Lodi fire marshal dies

A 90-year-old Lodi woman who Bergen County authorities said was the victim of elder abuse at the hands of her son died yesterday, a little over a year after the incident. An indictment returned by a grand jury in Hackensack charges the 58-year-old son with elder abuse and aggravated assault “for attempted serious bodily injury with indifference to the value of human life.”

Ammie Carmona, 37, of 1711 Kelsey Ave. entered Alford pleas before Lucas County Common Pleas Judge James Bates to theft from an elderly or disabled adult and Medicaid eligibility fraud. She faces up to three years in prison at sentencing May 6.

Nursing Home Employee Charged with Assault

A person who was responsible for the care of an elderly patient is now charged with abuse in Luzerne County. The investigation into this case began last year. The patient told police she had a fight with the caretaker and that the woman had grabbed her arms and bruised her. She also said that the caretaker had covered her face with a pillow, took one of her dolls, and left.

A nursing home care worker was fired after he upset a 93-year-old dementia patient by taking her newspaper, allegedly to read on his break, a tribunal has heard. Mr. Doyle told the tribunal, chaired by Peter J O'Leary, that the woman became "quite agitated" when the newspaper was taken from her and "pulled it back towards her" but nonetheless Mr. Hogan then "took the newspaper and went on his break".

The state is examining whether to renew the Rose-Mary Center’s license. Earlier this month, it suspended the facility from accepting new residents.

In a 12-page order issued Tuesday, U.S. District Judge Kevin H. Sharp ordered Walter M. Strong of Celina to reimburse the couple for money he misappropriated and to pay damages to the wife for sexual battery charges.

On Wednesday, a trial for a woman accused of neglecting her severely disabled daughter took an unexpected twist when she changed her plea to guilty. Irma Espinoza, 52, of Athens stopped the jury trial and changed her plea of not guilty to guilty after one day of graphic testimony which depicted the long-term chronic neglect of her 17-year-old severely disabled daughter. The girl weighed only 29 pounds when investigators from Adult Protective Services and the Henderson County Sheriff’s Office became aware of her condition.

Four individuals enrolled as either caregivers or employers-of-record in Vermont’s Medicaid-funded Home and Community Based (HCBS) or Personal Care programs were separately arraigned yesterday in Vermont Superior Court for Windsor County on felony counts of Medicaid Fraud for allegedly billing for care to children and vulnerable adults that was not provided. Collectively, these individuals are alleged to have submitted thirty-four fraudulent timesheets for almost two thousand hours of care that was not rendered, resulting in overpayments by the Vermont Medicaid program of approximately $18,000.

A couple who fell for telephone scams offering a luxury car and gold bars ended up losing $13,600 in the fraudulent schemes, a YCSO spokesman said.  A deputy responded to a report of a married couple who believed they had been the victims of a scam, Dwight D'Evelyn said, and met with a man and woman in their 90s who told the deputy they'd lost several thousand dollars.

The Arizona Supreme Court has agreed to review a lower court's decision allowing lawsuits against hospitals under a state law to protect vulnerable or incapacitated adults from neglect, abuse and exploitation.  The Court of Appeals ruled that the law exempts physicians and certain other specified care providers but not hospitals.

The state Department of Public Health has fined four nursing homes more than $1,000 each for one case of physical abuse and incidents that left residents with cuts, bruises and a broken bone. On Jan. 23, Arden House in Hamden was fined $1,020 in connection with an incident of physical abuse of a resident by a nurse’s aide, DPH records show.

A 62 year-old woman of Northfield, a lawyer who specialized in elder law, and a 57-year-old woman of Linwood, were arrested Wednesday on charges that included money laundering, conspiracy, and theft, said acting Attorney General John J. Hoffman.

The agencies that investigate abuse and neglect in Ohio’s 88 counties received 14,646 reports of abuse, neglect and exploitation of people 60 or older in the 2013 fiscal year that ended on June 30, according to state officials. The Ohio House recently passed a bill designed to protect older Ohioans from losing their life savings or homes. The proposal expands the definition of elder abuse under Ohio law to include financial harm, neglect and exploitation.

The authors explain that over the last decade, researchers have focused on developing assessment tools to identify deficits in financial decision-making and vulnerability to undue influence long before they become apparent to family members, caregivers, and financial or legal advisors. Other approaches can detect neurological impairments even five to ten years before the formal diagnosis of dementia or other cognitive disorders. Yet, these instruments, which can often be administered by primary care physicians, nurses, and occupational therapists, have not gained traction in clinical practice, the authors state.

An elder abuse case that has lingered in county court for almost two and a half years reached partial conclusion earlier this month. Barbara Deluca, one of two co-defendants in the case, was originally charged with neglect of an at-risk victim, a Class 1 Misdemeanor. She reached a plea agreement, and the case never went to trial. At a sentencing hearing on Feb. 6, Ouray County Judge David Westfall dismissed the charge of at-risk neglect and found Deluca guilty of a lesser charge of harassment.

A Garden City woman on Thursday was sentenced to 20 years in prison – with six to serve – and her co-defendant to 20 years with eight to serve for their convictions on elder abuse charges. Assistant District Attorney Shalena Cook Jones, who is the elder abuse prosecutor, said that between June 1 and June 26, 2012 Wiggins and Nesmith deprived Wiggins’s mother of food and water and withheld her necessary medications, evidence showed.

A jury recently slapped Kindred Healthcare with a $2 million verdict in a resident abuse case that turned on testimony from medical experts, attorneys announced Thursday. An 87-year-old resident at a Kindred facility in Massachusetts* was found with genital bruising and bleeding, according to court documents. Kindred argued she sustained the injuries in a fall, while her lawyers argued that she had been assaulted.

Each year, according to the Alliance for Health, about 80,000 Michigan elders fall victim to some form of criminal abuse — and one of the most common types is financial, in the form of fraud and embezzlement. Last year, the Adult Protective Services staff at the Kent County Department of Human Services received 19,000 calls reporting abuse, up from 12,000 calls in 2000. The Alliance for Health says many more cases go unreported to authorities.

A Senate committee Tuesday gave swift approval to a bill that is being criticized by elder-care advocates as a “sweetheart deal” designed to help nursing homes and trial lawyers make money but do little to improve the quality of care for the homes’ residents. The Senate Health Policy Committee voted 8-1 for a bill that would shield nursing home investors from lawsuits when their homes are accused of abuse and neglect. In exchange, it would give trial lawyers easier access to documents, the article states.

The author states that one such document that nursing home residents have been faced with in increasing frequency is an agreement to arbitrate. The signing of this document by the resident or legal representative may waive the resident’s right to a jury trial in the case of abuse or neglect.

Paul Herrera. “Nista, who knew the victim was an elder adult, severely assaulted Zuniga in commission of the robbery, which led to his death.”

The corporation operating the home and the facility’s top administrator were also charged with trying to cover up the circumstances surrounding the death.

The state Supreme Court has declined to review a ruling by this district’s Court of Appeal, ordering a new trial in the case of an elderly man awarded more than $4 million in damages and attorney fees as a result of a fall at a nursing home.  The panel, however, upheld the jury’s findings that the defendants violated Samuel Navarrez’s rights under the Patient’s Bill of Rights by inadequately staffing the facility and by failing to offer restraints to keep him from falling, a violation of the statutory duty to provide material information to patients.

In fiscal year 2013, the agency received 7,986 abuse reports, up from 6,722 reports in fiscal year 2009.

The investigation of a possible Social Security fraud by an Oroville area man led to the discovery of his father’s dead body buried 16 miles northeast of Ellisforde.  Sheriff Frank Rogers said that "During one of their investigations they had received information that a subject living in Okanogan County had been taking his father’s Social Security funds, after the father had killed himself and the son had buried him on their property,” Sheriff Rogers wrote in a press release on Monday.

Robert Blancato, Aging Advocate, states that in a recent article published in The Gerontologist and highlighted in The New York Times, researchers note that children who were victims of abuse have more frequent depressive symptoms when caring for their abusive parent than caregivers who have not been abused. In addition, those caregivers who had been abused during their childhood have a greater chance of abusing their elderly parent continuing the pattern of abuse.

Daleville Police Chief Harvey Mathis is applauding a new law aimed at protecting Alabama’s senior citizens from abuse, neglect and financial exploitation.  Mathis said the Protecting Alabama’s Elders Act (SB29) is more specific, better defines abuse and neglect of the elderly, protects senior citizens from exploitation and provides a number of penalties for those who perform crimes against individuals 60 and older.

A judge in Hackensack today rejected a bid by Lodi Fire Marshal Paul Wanco to have charges of abusing his elderly mother dismissed, setting the stage for either a plea bargain or a trial.  “I’m setting a plea cutoff (March 10), and I intend to set the case down for a trial date,” Superior Court Judge Edward A. Jerejian told Wanco, who is accused of deliberately leaving his then-89-year-old mother lying on the floor in her own urine and feces for nearly 15 hours.

Javier Arango Vazquez, 22, pleaded no contest Thursday to one felony count of financial elder abuse by a caregiver, the Monterey County District Attorney’s office said.  Arango, while working in the victim’s home, stole several checks and accessed her credit card, prosecutors said. He wrote and cashed checks to himself for more than $4,000, they said, and used her credit card to purchase a phone and pizza, among other things.

On Wednesday, Feb. 5, citing California Penal Code Section 368, we, the evicted, gentrified, policed, elderly and disabled, walked into the Hall of Justice in San Francisco to bring criminal charges of elder abuse against landlords for the perpetration of the crime of Ellis Act evictions against frail, elder, disabled and traumatized residents of San Francisco.  The article states that thousands of families with young children and disabled elders have been served with Ellis Act eviction notices, or have already been evicted, ending up in the streets, in shelters or dead from the trauma of eviction and homelessness.

Man arrested for elder abuse

At 11:15 a.m. on Sunday, a Yucaipa Deputy responded to a residence in response to an elder abuse call. Upon investigation, it was found that Yucaipa resident Gregory Taverner, 49, had been in an altercation with his 75 year-old female neighbor.  According to the police report, during the altercation he repeatedly yelled and cursed at her. Taverner also followed victim on foot for two blocks with his 45-pound aggressive dog.

Founder of the Forget Me Not foundation discusses new legislation in Colorado.  In 2013, the Colorado Legislature passed a law to cut down on elderly neglect and abuse. Under Senate Bill 13-111, a new class of protections was formed for what the bill calls “at-risk elders.”  This year, the Colorado General Assembly is making amendments to strengthen the law under Senate Bill 98, which — if passed — will better define certain provisions in the law, the author states.

PHI is working with the Indiana State Department of Health to reduce the occurrence of adult abuse, mistreatment, neglect, and misappropriation in the state's nursing homes.  In November 2013, PHI Organizational Change Consultant Cean Eppelheimer and Cathy Macomber, assistant professor of social work at Saginaw Valley State University, led a train-the-trainer session to prepare key long-term care leaders to teach the Training to Prevent Adult Abuse and Neglect (TPAAN) curriculum.

A former skilled nursing facility employee in Indiana is facing charges including reckless homicide in the death of a resident, according to local reports.  The investigation by the Dearborn County Special Crimes Unit began when a witness said she saw the employee abusing the resident in a manner consistent with what a pathologist later determined was a broken vertebra.

The Polish immigrant accused of torturing a Quincy dog has been indicted on four larceny charges for allegedly stealing from the elderly woman for whom he was a caretaker.  “The financial exploitation aspect of this case has involved a far-reaching and involved examination of bank and other financial records through the grand jury process,” District Attorney Michael W. Morrissey said in a release.

A brother and sister from Parksville were arrested Saturday and charged with stealing more than $3,000 from the account of an elderly woman, state police in Liberty said. A Paris woman was charged with gross negligence after an ambulance crew found an elderly man in her care covered in bedsores and human waste last week.  According to the report by Patrolman Jamie James, the incident began when an emergency medical service received a call about an 87-year-old man with stomach pain. When they arrived on the scene, they found the man stuck to a couch by his own feces, and with very large bed sores on his back.

The former director of nursing at a Virginia long-term care facility has pleaded guilty to one felony count in a case involving residents with severely infected pressure ulcers, according to local reports.  The case involves two residents of Brian Center, a nursing home that closed in 2012. One resident had infected pressure ulcers covered by feces-contaminated bandages, and the other had pressure sores infested with maggots, according to an indictment cited by the Times News.

A provincial investigation found staff at a Calgary nursing home violated the law by failing to inform authorities when its residents were sexually abused.  The Alberta Health report also determined actions taken by management at McKenzie Towne Care Centre eight years ago were “insufficient” to halt repeated assaults by a male resident on women in the facility’s dementia unit.

A state report says video shows five staff members at a Gordon assisted-living home beating and abusing patients.  The report accuses five other staff members at Total Care Personal Care of neglect, because they witnessed patients being abused or saw injuries and failed to report them.  A report obtained from the Georgia Department of Behavioral Health and Developmental Disabilities says a staff member at the Total Care Personal Care Home used a belt to whip a patient at least 18 times.

Andrew Cuomo’s office Monday, displaying photos of injuries she blamed on aides working at a state-funded group home.  “The actual emergency room physicians told me this was either a severe blow or several blows to the head,” she said, but has been told all of his injuries were unsubstantiated the article states.

The agency established last year to protect the disabled in state-funded institutions has received nearly 25,000 reports of significant incidents, abuse, neglect and deaths in its first six months, though the public knows little about how many of those reports led to prosecutions, arrests and firings.  Data recently obtained by The Associated Press under New York's Freedom of Information Law show more than 42,000 hotline reports from June 30 through early December, including 14,747 significant incidents that can include injuries, 7,506 claims of abuse and neglect and 1,904 deaths.

A Nevada man was arrested by Hurricane Police Thursday for alleged abuse of his 22-year-old autistic son, and on Friday the Washington County Attorney’s office initiated prosecution bringing the charge before the Fifth District Court in St. George.  Covington’s 22-year-old son is autistic and unable to care for himself, relying upon his father and other trusted adults to do so, the probable cause statement filed in connection with the arrest stated.

The FOX6 Investigators were recently contacted by a Milwaukee mom at her wits end, trying to protect her disabled son from financial ruin.  The woman estimates her 45-year-old son who has cerebral palsy has given away nearly $27,000 in personal checks and cash since 2011. She says most of that money has gone to a Milwaukee woman named Carmen Lacey, who is a home healthcare worker.

Suffolk: more cases of vulnerable adult abuse in county than any London borough

Statistics from the Health and Social Care Information Centre, which were published yesterday, show a total of 3,015 referrals were made to Suffolk adult social care safeguarding teams in the 2012/13 financial year. The county has the second highest number of substantiated reports of abuse in the country with 645 fully-substantiated and 315 partially-substantiated.  In Suffolk, 2,005 of the referrals were for women and 1,010 for men while nearly half related to adults with a physical disability.

The article states that Thacker voluntarily walked away from the residence without the reporting party’s knowledge.  Her body was later found and confirmed deceased by Sheriff's Personnel.

On March 29, 2012, the city condemned a soon to be 80-year-old’s house, and she says she has been living in her van ever since. The Department of Housing and Community Development's ombudsman met with the woman several times to extend offers of help during 2012, according to Cheron Porter, a spokeswoman with Baltimore Housing. "None was ever accepted," she says, and that included an offer of rental assistance. At some point, housing officials made the Department of Social Services and its Adult Protective Services group aware of the situation, but the woman does not appear to have accepted any help.

New House Bill 4114 would create a network of trained volunteers who, if resources permit, could submit quarterly reports to the courts by having court-sanctioned permission to follow-up on the protected person. Petaluma Police report that several Petaluma residents were recent victims of schemes classified as “Top Ten Senior Scams” in a list compiled by the National Council on Aging.  Dozens of elderly Petaluma residents lost millions of dollars to Aldo Baccala, who is currently facing 123 counts including grand theft, securities fraud and elder financial abuse in a widespread Ponzi scheme uncovered in 2012.

Lisa Gray-Garcia led a press conference outside the San Francisco Hall of Justice Feb. 5 to announce that she and fellow activists were filing elder abuse charges against San Francisco landlords. Gray-Garcia said criminal charges were being filed against the landlords in accordance with California Penal Code 368, which creates a special category for crimes – such as infliction of pain, injury or endangerment – committed against elders and dependent adults.

Colorado attempts to discourage financial exploitation of older people in a couple of ways discussed in this article.  One way is starting July 1, people in health care industries, law enforcement, fire protection, social work, banking and government services, among others, are subject to a mandatory reporting obligation within 24 hours of observing exploitation - or the potential for exploitation - of an "at-risk elder" the author states.

A former nursing home nurse is charged with abusing a 77-year-old patient to death.  An autopsy was conducted and ruled that Scalf died as a result of a broken vetebra.  The nurse is charged with battery resulting in the death of an endangered adult, neglect of a dependent resulting in serious bodily injury and negligent homicide.

The Iowa Legislature has many issues on its agenda. My hope is that lawmakers will not forget older Iowans, the author states.  Iowa has an adult dependent abuse law, however, it protects only those who are dependent and abused by their caretaker. Over 50 percent of the reported cases of adult abuse have been rejected because of this narrow law.

A longtime Maple Grove City Council member pleaded guilty Wednesday to taking at least $35,000 from her ailing father while she had his power of attorney.  LeAnn Bobleter Sargent, 63,was charged in January 2013 with three felony counts, accused of using her power of attorney to raid the trust fund for her own benefit from 2009 until days before her father, Robert Bobleter, died on March 12, 2012, at age 84.

When a client of Peter Liounis' called and said he needed to access the cash in his father's investment account to put the elder man, who had suffered a heart attack, into assisted living, Liounis lied to him, said federal prosecutors.  Liounis, a Staten Island resident, told the younger man his father only had $3,000 in his Grayson Hewitt account, prosecutors said. It actually contained $23,000.

Cherokee County sheriff’s investigators are looking into a possible case of elder abuse.  According to a report filed by Deputy Raymond Hendricks, authorities were called to a Tahlequah hospital last week when the victim was treated for multiple wounds. Nurses told Hendricks they had found wounds on the man’s back side containing a severe infection.

Seven times since April 2012 police went to the Arlington Heights home of a man and his girlfriend accused of using baseball bats to discipline his mentally challenged 25-year-old grandson.  Jimmie Peterson, 68, and Michelle Thompson, 61, admitted to investigators that they beat Cherron Peterson with belts and bats, withheld food, and taped him to a wooden chair and locked him in a third-floor storage room, according to a criminal complaint.
