A new report says Adult Protective Services has not properly investigated abuse allegations at a Lexington group home for disable men.  It is suggested that one of the reasons for the failure is because officials are concerned that if the home closed the men there will have nowhere to go.

Couple Accused of Mistreating Man With Down Syndrome

Adult Protective Services were notified when a 48-year-old man with down syndrome was brought to the hospital with extensive bruising, sores, and weight loss.  His primary caregivers are his brother and his brother’s girlfriend; both were arrested with the charge of multiple counts of first degree criminal mistreatment.

Elk Grove police are looking for a 70-year-old woman with dementia who drove away from her home on Sunday and has not been seen since.  Jennell Bolds-King is African-American, about 5 feet 5 inches tall, 138 pounds with gray hair and brown eyes.  She was wearing a turquoise blouse and blue jeans; she wears gold-framed eyeglasses.  Anyone who has information about her whereabouts is asked to call police dispatch at 916-691-5246.

Lee County Sheriff’s is asking for help locating a 74-year-old man with dementia, Charlie Halcomb.  He was last seen in the Pilot truck stop in Fort Myers.  He is 5 feet 9 inches tall, approximately 220 pounds, with gray hair and blue eyes.  Anyone with information is asked to call the Lee County Sheriff’s Office at 239-477-1000.

•             The Office for Victims of Crime released a solicitation yesterday under which it will fund up to ten awards of $150,000 to $750,000 to support organizations that use technology creatively to provide outreach and direct assistance to victims, particularly those who have never been served or for whom services are not readily available, nationally and/or internationally (for Americans abroad). OVC plans to fund three categories of projects: National-Scope Victim Service Initiatives, National Scope Victim Service Initiatives Proposing To Serve Underserved Victims Identified by the Applicant, and Victim Service Initiatives for American Victims of Domestic Violence and/or Sexual Assault Abroad. Three people were arrested during a home probation check, including one on suspicion of elder abuse.  A 54-year-old woman was found in a room surrounded by trash and rotting food; the room also smelled of urine and feces.  The 54-year-old woman was the dependent of another adult in the residence.

A 63-year-old woman and City Council member has been censured and asked to resign her position after she was charged with three felony counts of using her power of attorney position to raid her father’s trust fund for her own benefit from 2009 to 2012.  She plead guilty to one count of financial exploitation of a vulnerable adult.

A husband (76) and a wife (55) were found dead in their mobile home on March 14, 2014.  Although the coroner ruled the deaths due to natural causes, local officials reported being worried about the couple’s living conditions for some time.  Local law enforcement personnel had been making visits to the home and were concerned by the number of space heaters used in the home and the gallons of fuel also stored in the home.  They also reported finding the couple living alongside cat urine and feces.  Adult Protective Services had been notified about the couple.

Adult abuse and neglect cases have increased by 27 percent in each of the past two fiscal years, and Adult Protective Services had 8,800 open cases at the end of February, the Arizona Capitol Times reported. Mary Lynn Kasunic, president and CEO of the Area Agency on Aging, which works with Adult Protective Services, said the most frequent type of investigations in Arizona and nationwide involve neglect, either self-neglect or by a family member.

The indictment says that on or between Jan 17, 2012, and May 7, 2012, the four knowingly obtained a benefit by means of false or fraudulent pretenses, promises or material omissions in violation of state law, a Class 2 felony.

In Los Angeles County, there were 3,044 open as of mid-March, 945 of which date back two years or more, according to an audit released last week by the Los Angeles County Auditor-Controller.  Jonathan Fielding, who heads the county public health department, says all cases have been investigated but not all have been written up. Under questioning by Los Angeles County supervisors last month, Fielding said that the department does not have adequate funding or staffing to meet all federal and state requirements. The division has an annual budget of $26 million but needs $33.5 million, he said.

After the Johnson’s were denied a loan in December 2011 to purchase a 2011 Buick Lacrosse, Eric Johnson returned to Pen Air Federal Credit Union with his wife’s elderly client and used the elderly woman’s good credit to obtain a $28,583 loan as a co-signer, deputies said. The elderly woman, according to an arrest report, lacked the physical and mental capacity to consent to the loan.

When a man answered the door and said he was a family member, Jogiat became suspicious and called police.

The male caregiver who drugged and raped an 89-year-old woman last year at a northern Minnesota senior home has agreed to a $10 million settlement in a lawsuit that arose from the incident. The convicted rapist, Andrew Merzwski, 30, will be required to pay the money only if he is convicted of another sexual crime or is found guilty or liable of abusing a vulnerable adult during the next 10 years, according to a settlement agreement reached in late March.

Henderson then walked out of the restaurant and threatened Torres, saying that if he ever saw Torres singing and dancing on the corner again, Henderson would harm him, the report said.

Attorney General Pam Bondi today announced the arrest of a caregiver for one felony count of abusing a mentally disabled person. The man was arrested for one count of abuse of a mentally disabled person, a third degree felony. If convicted, he could face up to five years in prison and up to $5,000 in fines. The case will be prosecuted by the Orange County State Attorney's Office.

State investigators twice received reports that a man was being neglected or abused before he was found dead, curled in a fetal position and weighing 60 pounds, inside a Belleville home in March. The 52-year-old man was blind, mentally and physically disabled. He lived with his brother and sister-in-law, since about 2006.

The state of Tennessee confirmed Friday that a severely disabled man was neglected by his caregivers. The 34-year-old man was born with cerebral palsy and profound mental retardation and was supposed to be getting the round the clock care and medical attention he needed in order to survive.  But according to the just finished report by state, investigators with the Department of Intellectual and Developmental Disabilities said Blake was the victim of neglect at the home run by Nashville-based Tennessee Family Solutions.

State health officials say a flash drive containing personal information of more than 2,500 people was stolen earlier this year. The department says the flash drive contained personal information of living and deceased individuals, including names and addresses. It says more than 1,500 records also included either a Social Security number or a Medicaid identification number.

Weldon had been charged with five felony counts last year after investigators with the state’s Medicaid Fraud and Residential Abuse Unit discovered he had continued to bill the federal government nearly $10,000 over a four-year period for services his daughter was supposedly providing to a disabled adult in Vermont after she’d moved to Georgia to attend college.

An elderly Victoria couple has gone to B.C. Supreme Court to try to take back control of their lives, after they were committed and held in hospital after going there for care. The doctors found both incapable of caring for themselves or each other at their suite in an independent living home for seniors. But the 84-year-olds claim they are capable of looking after themselves with the aid of a nurse, and recorded a video statement from the hospital ward that is now their home and what they describe as their prison.

A survey by the National Investor Protection Trust found 20 percent of Americans 65 and up — 7.3 million people nationwide — have been victimized by financial swindles. The survey found more than one out of three seniors has been approached by people asking for money, bail, or fees to claim supposed lottery winnings, among other schemes. Despite a growing number of reports of all types of elder abuse, Richard Strobel, chief counsel for the Burlington County Board of Social Services, said the largest number of abuse reports stem from cases of self-neglect.

Pablo Sela age 49, of Santa Barbara, was arrested for receiving stolen property, elder abuse, and drug offenses arising from an ongoing burglary investigation being conducted by the Santa Barbara Police Department's Property Crimes Unit. Due to declining heath, in recent months the 83-year old owner of the store and victim in this case has been unable to maintain a regular presence at the business. Investigation indicates that over the course of 3 to 4 months a suspect or suspects exploited the owner's absence and stole approximately 1.5 to 2 million dollars worth of antiques from a locked storage room at that location.

By adopting the UAGPPJA, New York will now recognize adult guardianship orders from 37 other states, the District of Columbia and Puerto Rico, with the jurisdictions being required to recognize a guardianship order from the state of New York.

The North Carolina Senior Tar Heel Legislature (STHL) convened in Raleigh March 20-21 for its first meeting of 2014. During the meeting, leaders shared information regarding the rise in elder abuse cases in North Carolina. Dennis Streets, director of the North Carolina Division of Aging and Adult Services (DAAS), stated that the total APS reports increased by 54 percent from 2007 to 2013; from about 14,200 to nearly 21,800.

The West Virginia Supreme Court recently heard positions on a matter concerning a $91 million judgment against a Charleston nursing home. In 2011, a jury found out that Heartland of Charleston did not adequately feed and care for one of its residents, who stayed at the nursing home for approximately 21 days. Eighteen days after the resident's release from the facility, the 87 year-old woman passed away.

A Coroner is expected to make recommendations to the care sector on Wednesday, as she delivers her conclusion on the death of a dementia sufferer in a care home.  In the 87-year-old woman's case, the court heard she may have eaten a sandwich before she died, a food that she should not have had because she was on a special diet of mashed meals at the old Spring Lane Residential Home, Lambley.

This free webinar is part of a series of National Elder Rights Training Project webinars for the National Legal Resource Center. This webinar will focus on nursing home admissions agreements, identifying the terms that elders and their advocates should be most wary of and explaining the protections that some states afford against enforcement of some of these terms. Though presenters will cover a range of issues, we will focus on arbitration clauses, attempts to hold family members liable for a resident’s bills, purported waivers of a facility’s liability, and improper grounds for eviction.   • The 3rd World Congress on Adult Guardianship will be convened on May 28-30th , 2014 in the Washington DC Metropolitan Area.   • The National Institute of Justice is seeking proposals for research and evaluation related to the abuse, neglect, and exploitation of elderly individuals. Research that includes residents of residential care facilities also will be considered. Research proposed may be focused at the state, local, tribal, federal, juvenile justice policy and/or practice level. OVC plans to fund three categories of projects: National-Scope Victim Service Initiatives, National Scope Victim Service Initiatives Proposing To Serve Underserved Victims Identified by the Applicant, and Victim Service Initiatives for American Victims of Domestic Violence and/or Sexual Assault Abroad.
