Colorado is one of only three states that does not have a law specifically protecting our elder population from physical, sexual, caretaker and financial harm by requiring those in a position of awareness to report suspected abuse. Last year, Colorado’s legislature created a task force to study the issue. It recommended a system of mandatory reporting for the mistreatment and exploitation of at-risk persons over 70 years of age.

A certified nursing assistant who was accused of abuse of the elderly was found not guilty by a jury of six men following just five minutes of deliberation. His former supervisor there reported that he had attempted to smother an elderly female resident with a pillow. Aniello was charged with one count of abuse of an elderly person, which is a third-degree felony.

Former Cedar Grove Middle School secretary Bobbie Neil Ward is facing decades in prison after a DeKalb jury found her guilty of 21 of 25 counts of wide-ranging crimes against disabled and elderly victims on Jan. 16. Prosecutors told the jury that Ward took money from a disabled victim’s bank account and used the Social Security numbers of several other disabled people to set up utilities at 12 homes in DeKalb. She also used a deceased person’s information to set up utility services at two of the addresses, prosecutors said.

A retirement community in southwest Ohio is 1 of a handful nationally that offers shelter for victims of elder abuse. Cedar Village's Shalom Center in the northern Cincinnati suburb of Mason is marking its anniversary this month. Although more than 40 seniors were referred to the center, only three stayed there. Experts say that's an indication of how reluctant elder abuse victims are to seek help. They fear being cut off from family, feel ashamed, or are confused about what has happened.

A 19-year-old Athens man surrendered to authorities early Monday in connection with the daytime burglary of a disabled U.S. Army veteran’s home last week in western Athens-Clarke County. The teen fled without taking anything when the veteran pointed his gun at him, but the suspect caused $750 in damages to the victim’s door.

Coon Rapids Man Sentenced For Stealing From Vulnerable Adult

A 39-year-old man has been sentenced to 90 days in jail, $1,085 fees and $12,000 in restitution for stealing over $65,000 from an 82-year-old vulnerable adult, the Anoka County Attorney’s Office announced Monday. He admitted to swindling the vulnerable adult, who is now deceased, of jewelry and a vehicle.

A care home has admitted to calling prostitutes for disabled residents who are otherwise unable to have sex. The home is now under investigation by the local council over concerns the bizarre set-up could place vulnerable residents at risk of being exploited. Staff defended the policy as the best way to satisfy the 'primeval needs' of disabled people, and claimed that it prevented sexually frustrated residents from groping staff.

Wabash Police Chief Charles Smith and Wabash County Sheriff Bob Land are both in favor of new legislation that will require police to be trained to deal with those suffering from Alzheimer’s or dementia. This new bill was filed following an incident in June 2012 when 64-year-old James Howard, an advanced Alzheimer’s patient living in Miller’s Merry Manor in Peru, was tased by a police officer five times for refusing to enter an ambulance and comply with the officer’s commands.

JPSO is asking for the public's help in locating a man last seen Monday about 4 p.m., walking into the food court at Oakwood Shopping Center in Gretna. The missing man, 75-year-old Gerald Autin, could be in the early stages of dementia and may not be aware of his surroundings, police said.

Roxbury Ave. Staff at his adult care home reported he walked away and they were unable to find him. Investigators said Thursday afternoon his body was found in a backyard near his care home.

    • The American Bar Association has announced a further round of grants to be made in 2013 that will promote and support innovation in the delivery of civil legal aid.  These grants will go to the state Access to Justice Commissions.  The grants will fund projects in seven critical areas of innovation: expanding limited scope representation and other models for affordable services; improving language access and eliminating implicit cultural bias; employing public libraries as point of access for legal aid; enhancing fundraising outside the legal community; creating partnerships with health care and social services providers, government agencies and other new partners; preserving access for low-income people as courts implement e-filing; and increasing web-based delivery of pro bono services for self-represented litigants.  Eligible entities are state Access to Justice Commissions, which are formal entities that bring together the highest level of the state's courts, organized bar, and other stakeholders to support the expansion of access to civil justice for low income and disadvantaged people.  Applications for Grants to Promote the Creation of new Access to Justice Commissions are due by February 15, 2013; applications for Innovation Grants are due on May 1, 2013.

A Northern California woman faces felony charges after she allegedly bilked an elderly Campbell man out of a luxury car and hundreds of thousands of dollars. The Santa Clara County District Attorney’s Office reported today that the victim was “smitten” with the 30-year-old suspect and invested $200,000 in her fledgling company before buying her a Lexus. Prosecutors say the company actually belonged to the suspect’s boyfriend and that $50,000 of the pilfered money went towards paying off a victim in Nevada where the suspect is also facing criminal charges.

A Napa man is suspected of pushing a wheelchair into the shin of the elderly woman, causing a visible injury, police said. He also allegedly punched a wall heater, causing a dent, and broke the woman’s television by knocking it off its stand, police said. The suspect’s mother is the elderly woman’s caretaker.

An elderly woman called reported to police that a man had been physically and mentally abusive towards her over the past several days. She claims that the suspect punched a wall heater causing a dent and broke her television by knocking it off its stand onto the ground. She also said that the suspect had intentionally pushed a wheelchair into her shin causing a visible injury.

Man sentenced for financial exploitation of 88 year-old father

A man facing 12 counts for financially exploiting a vulnerable senior citizen has been sentenced following his guilty plea on two felony counts, with the remaining 10 counts dismissed. District Judge Todd Schoffelman sent Jeffrey Peter Pohl to county jail for a year. An 18-month prison sentence was stayed as long as Pohl can meet court conditions imposed for 10 years and provide restitution of $118,575. Among the stipulations, Pohl must not engage in gambling or enter a gambling establishment. He must not enter into certain contracts or provide financial advice to others.

A St. Louis-area man is facing charges for allegedly scamming an elderly dementia patient out of thousands of dollars. Maryland Heights police say the 88-year-old victim is a widow who lives alone and suffers from senile dementia. Relatives became suspicious when they noticed her car was missing, though it was later found. They began looking through financial papers and realized she had written several checks to the suspect for various home chores.

A St. Peters man is behind bars, accused of scamming an elderly woman out of thousands of dollars. The 38-year-old suspect is charged with financial exploitation of the elderly or disabled. Police say the suspect charged the victim hundreds of dollars for simple chores, saying the victim paid the man $325 to $400 to wash dishes.

A woman convicted of stealing from a man with intellectual disabilities has violated her probation and sentenced to finish the rest of her original prison term. Janet Gilmore was sentenced to nearly 7 years in prison for failing to fulfill the terms of her probation, which she received for teaming up with her boyfriend to steal more than $150,000 from a man with an intellectual disability.

Earlier this month, Dr. Alphonso Berry and two criminal colleagues—a married couple named Marcus and Beth Jenkins—pled guilty to defrauding the government by submitting more than $13.2 million worth of phony claims to Medicare over a seven-year period for group and individual psychotherapy sessions for severely mentally disabled adults that were never provided.

Four adults imprisoned in a dark Philadelphia boiler room, beaten and underfed, were confined like zoo animals, federal prosecutors said Wednesday in announcing a 196-count indictment against their alleged captors. The litany of federal charges against the alleged ringleader and her posse includes the first hate crime case of its kind -- the victims were mentally and physically disabled, the U.S. Attorney's Office said.

A group of five suspects is accused of holding at least four mentally disabled people in virtual bondage, depriving them of food and medical attention as they were moved among Pennsylvania, Texas, Virginia and Florida. Two people died as a result of the imprisonment aimed at funneling $212,000 in federal funds to one of the suspects, prosecutors allege.

Police say that there was an argument at the home on Christmas day, and the father gave his son 10 Trazadone pills. The father then tried to take his own life by taking 10 Trazadone pills plus 5 Temazepam pills mixed with Nyquil. When he allegedly botched the murder-suicide he drove himself and his son to the hospital.

The couple were sued in civil court in 2011 by the woman’s mother, an 88-year-old woman, for buying a home in Newbury Park with the mother’s money and refusing the put the home in her name. A jury on Dec. 19 found the couple liable for elder abuse and awarded the woman’s mother the house, worth about $500,000, in addition to $25,000 for emotional suffering, $9,000 for economic damages, and attorney’s fees.

A recent study suggests that physical changes in our brains as we age could explain why elderly people fall for scams more often than the rest of us. The study by UCLA researchers found that older people had more trouble picking up on visual cues in the faces of people trying to scam them. MRIs showed that a part of the brain called the anterior insula had less activity in older people confronted by untrustworthy faces than the same part of the brain in younger people did.

In some areas of the UK as few as one in three people suffering dementia will receive a formal diagnosis, while in other areas three quarters of sufferers will be told by a doctor about their condition, according to data released by The Alzheimer's Society. Across the UK just 46% of sufferers were diagnosed in 2012, the society said. Health Secretary Jeremy Hunt said the country should be "ashamed" that so many people were being denied treatment which could stave off the condition for years. He said that doctors are refusing to carry out tests for dementia as they believe it is pointless as there is no effective cure available.

The suspect is a man who claims he got into an altercation with Lewis as he walked the neighborhood searching for drugs.

The Frederick County Bureau of Investigation and the Maryland Office of the Chief Medical Examiner are investigating the death of Robert E. Saylor, 26. Saylor had Down Syndrome and had refused to leave a theater after watching a movie. A theater employee asked off-duty deputies to help remove the man. The deputies handcuffed the man, who suffered a medical emergency in the theater, and was later pronounced dead at Frederick Memorial Hospital. The cause of death has not been determined.

A trade organization representing most of Missouri’s nursing homes is making the case that the facilities are performing exceptionally well, despite being “underfunded, unnoticed, and underappreciated.” The comments by the Missouri Health Care Association came in response to a KMOX investigation Friday which showcased dozens of area nursing homes which had been fined by federal authorities for a number of deficiencies, ranging from sexual and verbal abuse to neglect.

A visiting nurse from 'Visiting Angels Nursing Service' was arrested for stealing $160 from a patient. The suspect was arrested Tuesday and accused of stealing the money from the patient's home. She had been hired by the victim’s family visit the victim twice a week since he is suffering from the onset of dementia.

The alleged victim has cerebral palsy, developmental delays and a seizure disorder; she cannot walk or speak. A former coworker of the suspect testified that she saw the suspect pour lemon juice in the victim’s eye, rub her eyes with hand sanitizer, and force her to eat whole peppercorns.

who had no prior record, had pleaded guilty last year to one count of financial exploitation of a disabled person. She took almost $9,000 from five residents by making numerous cash withdrawals with their bank cards.

More than 25,000 Minnesota residents have a court-appointed guardian or conservator to take care of their finances, and the number is expected to rise in the future as more Minnesotans enter retirement age.

A teenager pleaded not guilty on Monday to killing a developmentally disabled man in September. Prosecutors say the suspect told a witness he robbed a man, then shot him when the man fought back. The victim, a 38-year-old man, had just earned $40 in cash working as a maintenance man. His family says that he had trouble reading and writing, but always managed to provide for himself.

A Bismarck woman is accused of burning her 31-year-old disabled son with a cigarette. She has been charged with endangerment of a vulnerable adult, a Class B felony. A judge set her bond at $15,000 and ordered the suspect to have no contact with her son.

A local caregiver is sentenced to more time behind bars for causing the burns suffered by a patient in his care. He was accused of putting a developmentally handicapped patient in a tub of scalding water and faces up to three years in prison. However, prior to sentencing the defense, as well as the victim’s family, asked the judge to place him only on probation. A jury found the man guilty of one count of felonious assault as well as three counts of tampering with evidence.

At a time sexual violence against women is being protested across the nation, an officer of the Kolkata Police was on Wednesday caught raping a mentally disabled woman at her home in Beniapukur. The officer is accused of sneaking into his neighbor’s house in the afternoon while the 45-year-old woman was alone and began sexually assaulting her. When passersby discovered the crime, they raised an alarm, gathered a crowd, and beat the suspect until police arrived.

    • The American Bar Association has announced a further round of grants to be made in 2013 that will promote and support innovation in the delivery of civil legal aid.  These grants will go to the state Access to Justice Commissions.  The grants will fund projects in seven critical areas of innovation: expanding limited scope representation and other models for affordable services; improving language access and eliminating implicit cultural bias; employing public libraries as point of access for legal aid; enhancing fundraising outside the legal community; creating partnerships with health care and social services providers, government agencies and other new partners; preserving access for low-income people as courts implement e-filing; and increasing web-based delivery of pro bono services for self-represented litigants.  Eligible entities are state Access to Justice Commissions, which are formal entities that bring together the highest level of the state's courts, organized bar, and other stakeholders to support the expansion of access to civil justice for low income and disadvantaged people.  Applications for Grants to Promote the Creation of new Access to Justice Commissions are due by February 15, 2013; applications for Innovation Grants are due on May 1, 2013.

On Jan. 1, a new law SB1047, first proposed by a member of the California Senior Legislature, went into effect. Entitled "Silver Alert," this law would require that if a person is reported missing to a law enforcement agency, and that agency determines that certain requirements are met, including, among others, that the missing person is 65 years of age or older, the law enforcement agency shall request the California Highway Patrol to activate an electronic sign Silver Alert similar to the Amber Alert

A former middle school secretary was indicted by a DeKalb County grand jury on June 28, 2012, on a range of charges that include aggravated assault, forgery, abuse of disabled adults, identity fraud, and exploitation of an elderly person. Her trial is scheduled to begin this week.

Leaders from both the Senate Committee on Health and Welfare and the House Committee on Human Services say they’ll work to pass a bill similar to one that Governor Peter Shumlin vetoed last session. The bill would have required that the APS division report to the Legislature on elder abuse on a monthly rather than annual basis. It was introduced in response ot a backlog in investigations of elder abuse that had bogged down the APS division and prompted a lawsuit filed by Vermont Legal Aid.

A 68-year-old woman’s leased Ford Fiesta was covered with gasoline and set on fire in the early hours of Sunday. The car was completely destroyed, leaving the owner devastated. Det. Con Jason Bryant says the motability company is reluctant to provide another care because of the risk and this car was the woman’s lifeline. Anyone with information about this crime is asked to contact authorities.

Six people were arrested today after a morning melee in which a mentally handicapped adult was chased down by two people and a pit bull and beaten with a cup and a belt. Deputies responded to the disturbance at about and learned that the victim had been abused by household members reportedly as punishment for stealing a cell phone, according to a news release from the Escambia County Sheriff’s Office. The victim was forced to run up and down the street and had also been hit in the face with a coffee cup, beaten on the back with a belt and pushed to the ground, the release states.

A judge sent a 54-year-old Lincoln man to jail Thursday for assaulting a developmentally disabled woman a year ago. The perpetrator, who was the 64-year-old woman’s caretaker, slapped her and shoved her underwear in her face after she told him she had an accident at work and soiled herself.

A Kearns woman was sentenced Friday to five years to life in prison for ignoring abuse that eventually killed a mentally disabled woman living in her home. The 22-year-old victim was found dead on the floor of the family’s home. She had bruises on her body, bandages wrapped tightly around her arms and fingers, and a pepper seed stuck under one eyelid. An autopsy found that the victim was severely dehydrated and had potentially fatal levels of Benadryl or a similar drug in her system.

She was one of a group of five teenagers charged after the incident in September.

Police say a missing elderly man, who suffers from dementia, has been found safe and in good health. The man was found driving on the New Jersey Turnpike Saturday night after a Silver Alert was issued. He had gone missing from the Parx Casino shortly before 5a.m. Saturday morning.

She was arrested Dec. 20 after investigators learned she had befriended the man at church approximately 3 years ago. She first convinced the man to give her $30,000 from a CD, then used 8 of the victim’s credit cards to make purchases for herself.

A convicted rapist was charged with sexually abusing a 91-year-old woman in the Albany Shaker Road nursing home at which he worked as a maintenance employee. The suspect, a 64-year-old Level 3 sex offender, allegedly inappropriately touched the woman after going to her room to change a light bulb. He previously spent more than 16 years behind bars for the 1983 rape and sodomy of a woman in Saratoga County. He is now charged with endangering the welfare of a vulnerable elderly person, a felony, and misdemeanor sexual abuse.

According to the Glens Falls Post-Star, 38-year-old Kimberly Breault, of Queensbury, was found guilty of 10 counts of petty larceny last week after a trial in Town Court.

He said he "wanted them both to die."

The Salt Lake County Attorney's Office has issued an arrest warrant for Dr. John Meadors, whose commercials can be seen on Utah television. During a visit Meador's clinic, Utah Spine and Disc, prosecutors say a disabled and vulnerable adult unknowingly signed contracts giving her a $6,000 credit line and charging her $5,200 for 20 treatments. The victim had only three treatments, and asked for a refund, but prosecutors say meadors refused. The doctor is charged with one felony count of exploitation of a vulnerable adult.

Local attorney Bill Floyd said he saw the two leaving the Register of Deeds Office and realized Aiken was the subject of a Silver Alert that he had read about Wednesday on WRAL.com. The suspect has been charged with one count of false imprisonment.

    • The American Bar Association has announced a further round of grants to be made in 2013 that will promote and support innovation in the delivery of civil legal aid.  These grants will go the state Access to Justice Commissions.  The grants will fund projects in seven critical areas of innovation: expanding limited scope representation and other models for affordable services; improving language access and eliminating implicit cultural bias; employing public libraries as point of access for legal aid; enhancing fundraising outside the legal community; creating partnerships with health care and social services providers, government agencies and other new partners; preserving access for low-income people as courts implement e-filing; and increasing web-based delivery of pro bono services for self-represented litigants.  Eligible entities are state Access to Justice Commissions, which are formal entities that bring together the highest level of the state's courts, organized bar, and other stakeholders to support the expansion of access to civil justice for low income and disadvantaged people.  Applications for Grants to Promote the Creation of new Access to Justice Commissions are due by February 15, 2013; applications for Innovation Grants are due on May 1, 2013.

She is being charged by the County of Santa Clara’s office for felony count indictments claiming that she participated in the crime of theft, and/or embezzlement of more than $950 by a person, not a caretaker, from an elder or dependent adult, in violation of PC 368 (d). The alleged victim is the suspect’s mother. The suspect’s daughter has already been charged in connection with the theft.

In 2011, DHS Adult Protective Services received more than 28,000 reports of potential abuse, about 1,000 more than in 2010. In total, 2,935 seniors and adults with disabilities were victims of abuse in 2011.

The suspect admitted two counts of theft and has been ordered to do 60 hours of unpaid work and pay £250 compensation.

A month after he was charged with seven felonies alleging financial exploitation of his 92-year-old aunt, a St. Paul man has died, according to an official with the Department of Public Health, which maintains death records. He was charged in February with gross misdemeanor criminal neglect after medical personnel on Aug. 8, 2011, found his aunt with a bedsore and dried feces on her body. She reported being "in pain everywhere," according to the complaint.

The other did not complete a training required before providing unsupervised living services.

The daughter of a patient at Arbors became suspicious about how her mother was being treated and decided to take action, according to investigators.

A former Mount Pleasant nursing home aide has been released after posting a $100,000 bond on charges that he abused a 101-year-old bedridden man. At least some of the alleged abuse was captured on a hidden camera set up by the victim's granddaughter, according to media reports. The hidden camera shows images of Kimbrough shaking, taunting and harassing the elderly man.

The U.S. Department of Health and Human Services has awarded a $907,000 grant to the Texas Department of Family Protective Services, in partnership with the WellMed Charitable Foundation, the Benjamin Rose Institute on Aging and the Elder Justice Coalition. The grant, among the first awarded as part of the Elder Justice Act of 2010, will fund an elder abuse prevention and intervention initiative at WellMed clinics in five Texas markets.

Thieves work overtime this time of the year, and a prime target is the elderly. “There are a lot of different things at play this time of year that make it critical to have this conversation,” said Sandy Markwood, chief executive of the National Association of Area Agencies on Aging. “One thing is that we saw an increase in financial exploitation of older adults just because of the economic downturn, and people were looking at preying on anybody to get additional resources. But the other issue is at this time of year, there is just an awful lot of spending activity and oftentimes, it’s easy to pick up somebody’s personal information, their credit card information and maybe not to pay attention as closely if somebody has one of your checks and/or forged your signature.” she said.

Another Case of Elder Abuse at Retirement Community

A former resident of Envoy Home in Staunton, Virginia pleaded guilty to sexually molesting an elderly woman and will now spend a year in prison.  The Staunton Senior Center started a program to prevent elderly abuse in the Valley about a year and a half ago. That way, managers hope to prevent more cases in our area by teaching families what signs to monitor.

Three men and a woman have been charged with mistreating vulnerable elderly residents at a care home near Lancaster. The former employees are accused of a total of 19 offences under the Mental Capacity Act 2005 of being a carer involved in the ill-treatment and wilful neglect of a person with lack of capacity.

A man accused of getting a mentally-disabled patient at a nursing home pregnant last year is now in custody. The alleged victim is severely handicapped and legally blind. The suspect was arrested Thursday morning in Sacramento and was booked on a rape charge. He is being held on a $150,000 bail.

A Florida man posted a video on Facebook of a homeless man being punched in the face. Although the homeless man told authorities he didn’t recall being punched, police were able to file charges of aggravated abuse of a disabled adult against the cameraman and another suspect. Additionally, a misdemeanor battery charge was filed against the cameraman, and the other suspect faces a charge of felony battery with a prior conviction.

Woman sentenced for swindling disabled victim

A Columbia woman who in 2010 took thousands of dollars from a mentally disabled woman through intimidation was sentenced yesterday to probation instead of prison so she can pay back the victim. The woman pleaded guilty to felony financial exploitation of an elderly/disabled person and was sentenced to eight years in prison. Circuit Judge Christine Carpenter ordered her to serve 120 days in jail. If she completes that satisfactorily, she can be released on probation and would be required to pay $400 in restitution each month.

Catherine Knoll disappeared from the Area 6 outpatient clinic at around 1pm yesterday, after she was driven there from her Blairgowrie home by the Patient Transport Service. She was discovered 16 miles away in St Andrews several hours later — 32 miles from home. Police are unsure how she got to Fife but it is thought she wandered out of the hospital and boarded public transport.
