Elder financial abuse is an expensive drain on the U.S. economy. A study of media reports from April to June 2010 "estimated that financial exploitation cost older adults at least $2.9 billion" that year, according to a report by the Government Accountability Office, or GAO. According to the report: "The money that older adults lose in these cases is rarely recovered, and this loss can undermine both the health of older adults and their ability to support and care for themselves."

East Bay Judge Charged with Elder Abuse Resigns

An Alameda County judge charged with stealing thousands of dollars from his Berkeley neighbor, selling her art, and using her garage to store his Thunderbird has resigned and agreed to never be a judge again. He resigned in exchange for the Commission on Judicial Performance halting its investigation into him, according to the Oakland Tribune. The newspaper reported that he had remained on the bench - and continued to receive a paycheck - while his criminal case proceeded, though he had not appeared in court since his arrest.

At 3:45pm, Alta Bates hospital in Berkeley notified the El Cerrito police department that an elderly resident arrived at the hospital with numerous bruises over her body. Officers interviewed the woman at the hospital. The investigation is ongoing.

Saratoga Man Charged With Elder Fraud to Have Hearing at End of Month

A 71-year-old Saratoga resident is being prosecuted for “elder abuse, burglary and embezzlement.” A felony complaint was filed against the suspect on Oct. 17, 2012, in which he was charged with 16 felony counts.

A Selma woman has been arrested on an elder abuse charge in connection with the care of her mother, according to the Selma Police Department. Firefighters notified police that they were bothered by the 79-year-old alleged victim’s living arrangements, as one bathroom had no working tub or toilet, and the other was not wheelchair accessible. The woman seemed to be confined to her bed.

Cynthia Franke and Tyrone Javellana, of Hollywood, were convicted Tuesday of financial exploitation of an elderly person, a first-degree felony that could result in up to 30 years in prison. The couple were fully aware of the 94-year-old woman’s advanced dementia when they convinced her to sign over her $10 million estate and disinherit her family.

A South Florida couple has been convicted of exploiting a 94-year-old woman with dementia who prosecutors say disinherited her family and handed over her $10 million estate. Both Cynthia Franke and her husband, Tyrone Javellana, each face up to 30 years in prison after being found guilty of one count of financial exploitation of an elderly person, which is a first-degree felony. Javellana now faces an additional charge of exploiting the woman’s now-deceased sister.

A 49-year-old Stoughton man faces a felony charge of aggravated battery against an elderly woman following a disturbance February 14. According to a criminal complaint filed in Dane County, police were alerted to the alleged abuse of a 71-year-old woman by the Stoughton Area Senior Center. The victim, who suffers from a neurological disorder and is recovering from a stroke, alleged that the suspect had thrown a coffee cup at her the previous night, the complaint states. A Stoughton police officer observed two bruises on the woman’s shoulder.

A mother says she is devastated, after hidden cameras captured caregivers physically abusing her adult disabled son. Caregivers were recorded by hidden cameras kicking and punching her son Cameron, stomping on his face, spitting on him, whipping him with a chain and threatening him, possibly even shooting him with a pellet gun.

A local woman says she is the victim of fraud from a family member. Kristina Tribbey had her identity stolen and she suspects a relative, who was once considered a trusted friend. "She [the relative] had written down my Social Security number, my birth date, my full name, and she had copied down my bank card number," Tribbey said. The identity thief then used Tribbey's Social Security savings account to charge $1,200 worth of cell phone purchases through an internet marketing firm called Simplexity, leaving the family facing possible eviction and loss of their rental furniture due to the drain of the family's account.

The British government has apologised after the shooting of a disabled farm worker who ran away from soldiers almost 40 years ago in Northern Ireland. John Pat Cunningham (27) had a mental age of less than 10 and a great fear of men in uniforms. He was unarmed when shot dead by soldiers from the Life Guard Regiment near his home in Benburb, Co Armagh.

Two severely disabled prisoners were found crammed into a Victorian cell designed for one person for nearly 24 hours a day, inspectors discovered. Staff were unaware they could not use the shower on their landing as it was not adapted properly.

A northern Utah sheriff's office is floating a unique and unproven idea for keeping seniors with Alzheimer's disease and dementia safe: Give them ankle monitors normally used on criminals on house arrest or parole. Davis County Deputy Sheriff Kevin Fielding says the monitors would allow deputies to quickly find a person who has wandered off. That would save lives and save taxpayer funds by avoiding time-consuming searches.

    • The American Bar Association has announced a further round of grants to be made in 2013 that will promote and support innovation in the delivery of civil legal aid.  These grants will go to the state Access to Justice Commissions.  The grants will fund projects in seven critical areas of innovation: expanding limited scope representation and other models for affordable services; improving language access and eliminating implicit cultural bias; employing public libraries as point of access for legal aid; enhancing fundraising outside the legal community; creating partnerships with health care and social services providers, government agencies and other new partners; preserving access for low-income people as courts implement e-filing; and increasing web-based delivery of pro bono services for self-represented litigants.  Eligible entities are state Access to Justice Commissions, which are formal entities that bring together the highest level of the state's courts, organized bar, and other stakeholders to support the expansion of access to civil justice for low income and disadvantaged people.  Applications for Grants to Promote the Creation of new Access to Justice Commissions are due by February 15, 2013; applications for Innovation Grants are due on May 1, 2013.

Selma firefighters say they found an elderly woman basically confined to her bed in deplorable conditions - and now her daughter is facing felony charges. The 40-year-old suspect is charged with elder abuse for the handling of her mother. The alleged victim was hospitalized and released to another facility, rather than her home.

A Red Bluff man charged with slamming a bathroom door into the face of a 74-year-old man was sentenced to six years in prison. The 32-year-old suspect, pled no contest to elder abuse in February and was sentenced in Tehama County Superior Court on Monday. The elderly man entered a Burger King restaurant bathroom when the suspect came out of a bathroom stall and slammed the door into the victim, knocking him to the floor and then slamming the door onto the man a second time.

A licensed elder care provider with 17 years of experience had a long history of complaint investigations, deficiency reports, citations, fines, and plans of correction. Still she never lost her license until an 88-year-old woman recently died with complications from a Stage IV bedsore under her supervision. The former care provider was charged with involuntary manslaughter and a second felony count of elder or dependent adult abuse, resulting in death. She faces up to 12 years in prison.

A bill before the Legislature would address elder abuse in Maine by closing a loophole and clarifying the law to protect elders who might be victimized. The man was found dead at his home in the 100 block of Summit Street. His family told CBS 6 that officers would only tell them “somebody killed him.” They say the door to the home was kicked in and there was blood in the dining room.

The reported abuses included cases of rape and molestation as well as allegations that a state worker used a Taser to inflict burns on a dozen patients.

The North Augusta Department of Public Safety is looking to question someone in an exploitation of a vulnerable adult case. The victim, who is said to be handicapped and incapable of making financial decisions, was befriended by the suspect in Augusta and brought to the Verizon store in North Augusta. The victim then gave all of his identifying information to store employees so the suspect could buy a phone. Investigators say the suspect has used the victim's identity multiple times to buy phones in other areas.

The group is vulnerable to financial advisers who boast meaningless credentials to sell bogus or inappropriate investments. Older Americans can even be victimized by loving family members who are clueless about their responsibilities as court-appointed money-managing guardians.

The Attorney General's office is touting the success its task force has had fighting elder abuse since its inception two years ago. The AG’s office is announcing the impact of the Taskforce Against Senior Abuse (TASA) in honor of Consumer Protection Week. TASA has received more than 2,300 calls to report potential abuse, neglect or fraud. One figure that was publicized was that 102 victims received restitution in a consumer fraud action against American Residential Services. 89% of the victims were senior citizens.

A 52-year-old man suspected of attacking a woman at a home in San Jacinto was jailed in lieu of $1 million bail today and facing possible charges of attempted murder, authorities said. A deputy who responded to the call for help at 2:15 a.m. reported seeing the victim being dragged from the porch, back into the home by the suspect. The suspect was arrested for attempted murder, elder abuse, false imprisonment and felony vandalism.

Police arrested a Vacaville man Saturday who authorities say is suspected of abusing an elderly woman who managed to escape and seek help at a local church, officials reported Tuesday. who was on Post-Release Community Supervision following a prior conviction for elder abuse, was taken into custody by officers after they contacted the 74-year-old alleged victim. The victim told police that the suspect had stolen more than $700 from her bank account, and that she had been mentally and physically abused.

For the family of a 96 year old woman, frustrations have continued to grow. They caught aides on camera abusing their beloved relative while she was living in the Quail Creek Nursing Home and Retirement Center. The family said they first reported the abuse in April 2012 but to this day have not seen any findings from an internal investigation that the nursing home was supposed to conduct, according to the Oklahoma Department of Health.

It will also provide community groups with information kits on elder abuse and establish a multi-sector council to reduce abuse with an office in the Ministry of Health.

The nurse is also accused of serious clinical errors, including making a patient wait five minutes for crucial first aid because she did not know whether there was a “do not resuscitate” order in place. She also failed to carry out checks on a diabetic patient who later had to be rushed to hospital with low blood sugar.

    • The American Bar Association has announced a further round of grants to be made in 2013 that will promote and support innovation in the delivery of civil legal aid.  These grants will go to the state Access to Justice Commissions.  The grants will fund projects in seven critical areas of innovation: expanding limited scope representation and other models for affordable services; improving language access and eliminating implicit cultural bias; employing public libraries as point of access for legal aid; enhancing fundraising outside the legal community; creating partnerships with health care and social services providers, government agencies and other new partners; preserving access for low-income people as courts implement e-filing; and increasing web-based delivery of pro bono services for self-represented litigants.  Eligible entities are state Access to Justice Commissions, which are formal entities that bring together the highest level of the state's courts, organized bar, and other stakeholders to support the expansion of access to civil justice for low income and disadvantaged people.  Applications for Grants to Promote the Creation of new Access to Justice Commissions are due by February 15, 2013; applications for Innovation Grants are due on May 1, 2013.

On Feb. 16 police say a 77-year-old man suffering from dementia entered an Alzheimer's patient's room at Consulate Health Care and violently assaulted an elderly woman. After an evaluation by the Western Tidewater Community Services Board and physicians who treated the 77-year-old, it was determined that the man "did not have the mental capacity to formulate the criminal intent necessary to prosecute a criminal charge," according to Police Chief Vic Reynolds.

    • The American Bar Association has announced a further round of grants to be made in 2013 that will promote and support innovation in the delivery of civil legal aid.  These grants will go to the state Access to Justice Commissions.  The grants will fund projects in seven critical areas of innovation: expanding limited scope representation and other models for affordable services; improving language access and eliminating implicit cultural bias; employing public libraries as point of access for legal aid; enhancing fundraising outside the legal community; creating partnerships with health care and social services providers, government agencies and other new partners; preserving access for low-income people as courts implement e-filing; and increasing web-based delivery of pro bono services for self-represented litigants.  Eligible entities are state Access to Justice Commissions, which are formal entities that bring together the highest level of the state's courts, organized bar, and other stakeholders to support the expansion of access to civil justice for low income and disadvantaged people.  Applications for Grants to Promote the Creation of new Access to Justice Commissions are due by February 15, 2013; applications for Innovation Grants are due on May 1, 2013.

A DeKalb County woman has been sentenced to 30 years in prison for crimes against the elderly. She was sentenced Monday after being found guilty of abusing six disabled, elderly people over a five-year period. She was charged with neglect, exploitation, false imprisonment, forgery and 13 counts of identity fraud. DeKalb County District Attorney's officials say she took elderly people into her home, malnourished them and allowed them to live in squalid conditions. She also took money from the victims' bank accounts and signed their names on government checks without their permission

A former personal banker with an affinity for Louis Vuitton copped to bilking about $300,000 from a dementia-inflicted woman and was sentenced to up to nine years in prison Monday. He pleaded guilty to grand larceny and possession of stolen property in Manhattan Supreme Court in exchange for a sentence of three to nine years behind bars. The man’s victim died just weeks before he was arrested.

A con artist has admitted to stealing $300,000 from an elderly woman in Manhattan, according to a report from The New York Post on Monday, February 25. The man claimed to have targeted his 91-year-old victim while working at her bank in 2009. He convinced her and her family to condense separate checking accounts into one, and to allow him authority of oversight. The victim died shortly before the man was arrested.

A Rochester area nursing home worker has been charged with assaulting an 83-year old woman. The state Attorney General’s office reports they have surveillance tape of the suspect throwing chicken bones at a woman in the Park Ridge Living Center in Greece. The attack happened after the woman allegedly threw napkins at him in November 2012. The worker is also accused of slamming the wheelchair-ridden woman into a door. The suspect could face one and a third to four years in prison if convicted.

Riverside police say they've arrested a woman they believe beat and stabbed an 80-year-old woman, stole her car and broke into a neighbor's home and stabbed their dog. Officers say the 25-year-old suspect was arrested early Tuesday for investigation of attempted murder, home invasion robbery, burglary, animal cruelty and vehicle theft. The elderly victim is in serious but stable condition.

A known gang member was arrested Wednesday on robbery and attempted murder charges after snatching cash from a disabled man and pushing him and his wheelchair into oncoming traffic on U.S. Highway 192, the Osceola County Sheriff's Office said. Jose Mojica de la Rosa survived the attack uninjured on Saturday evening, but his 9-month-old Chihuahua, Lola, broke a leg when she was crushed beneath the overturned wheelchair, according to interviews Wednesday afternoon. In addition to attempted murder and robbery, the suspect is charged with abuse on a disabled adult, petit theft and animal cruelty. He remains held without bail in the Osceola County Jail.

A male nurse in southern New Jersey has been found guilty of sexually assaulting a quadriplegic man in his care and videotaping the incident. Prosecutors say the 34-year-old "catastrophically injured" victim, who was nonverbal and incapacitated and therefore unable to consent. The former nurse could face up to 40 years in prison at his May 17 sentencing

A Troutdale man accused of raping a developmentally disabled woman was arrested Wednesday by Multnomah County sheriff's deputies. A man from Laramie County has been found guilty of multiple counts of Medicaid fraud. A jury found him guilty of fifteen felonies and a misdemeanor stemming from making false Medicaid claims. He had previously worked at the Developmental Resource Center in Cheyenne helping developmentally challenged and mentally disabled Medicaid patients. An investigation conducted by the Medicaid Fraud Control Unit uncovered evidence he had unjustly inflated bills and even charged patients for services they did not receive.

Rideaux was last seen wearing an orange UT windbreaker with black and blue on it. She was also wearing black pants and blue shoes. She was described as a black female with hazel eyes and black hair. She stands 5-feet-10 and weighs 180 pounds.

The State of Colorado is one step closer towards legislation protecting the elderly from abuse. Senate Bill 13-111 would require certain individuals to report any suspected elder abuse within 24 hours. The bill passed its first senate committee vote Wednesday. It requires caregivers, physicians, nurses, social workers, pharmacists and bank personnel to report suspected abuse to a law enforcement agency within 24 hours or face a class three misdemeanor, punishable with a $750 fine or up to six months in jail. The bill defines abuse as bodily injury, confinement, sexual conduct and caretaker neglect.

A Newbury Park Financial Planner was arrested today for Financial Elder Abuse and Money Laundering following the execution of a search warrant at his business and home. The suspect allegedly embezzled money from an 89-year-old victim. Suspicions were reported to police by a concerned family member.

A bill requiring people in certain occupations ranging from medical care to the clergy to report abuse of seniors cleared a Colorado Senate committee on Wednesday. Senate Bill 111 is the product of an elder abuse task force that met last year to make recommendations on legislation requiring mandatory reporting of elder abuse. Colorado is one of only three states that does not have such a law.

The Colorado State Senate Judiciary committee passed a bill today that would make it mandatory to report the abuse of elders. If the bill passes through the entire state Senate, certain individuals would be required to report to law enforcement whenever they suspect abuse, neglect, and/or exploitation of any elder 70 or older. Colorado is only one of three states that does not enforce the mandatory reporting of elder mistreatment.

Anastacia Oluoch, the woman accused in the abuse of a 90-year-old Baltimore man, has pled guilty to three counts of the abuse of a vulnerable adult and received a six-year sentence for her crimes. A brutal attack on the victim was filmed by the victim’s daughter. The Oluoch initially fled to Kenya, but with the help of federal authorities, Baltimore Police extradited Oluoch back to the U.S. so she could stand trial.

For the second time in less than a month, state officials have found evidence of neglect by a nursing home worker who failed to try to save a patient who was in distress and died. In the latest case, a staffer at a Minneapolis nursing home did not administer cardiopulmonary resuscitation (CPR) after being called to the resident’s room by employees who saw the man, who could not talk, “blink and take a last deep breath,” according to the report released Tuesday detailing the death at Benedictine Health Center on the southern edge of downtown.

Senate Bill 134 would revise portions of the existing Montana Elder Abuse Prevention Act, making it easier for prosecutors to use it in elder abuse cases. Specifically, it would eliminate the need for prosecutors to prove the victim’s capacity due to mental or physical impairment and clarifies that the definition of an older person is anyone over the age of 60. The bill also creates a mandatory minimum prison sentence of one year or a fine of $50,000, if a criminal financially exploits a senior and steals more than $25,000.

After two days of deliberation following a two-week trial, a jury found the man guilty of second-degree sexual assault by virtue that the woman, who was 20 years old at the time, was mentally defective to the extent that she was unable to consent to sexual intercourse.

The 26-year-old man with Down syndrome had refused to leave a local theater after watching a movie and was forcibly removed by police. While in custody, he was placed face down on the ground and became distressed. The Chief Medical Examiner ruled the cause of death as asphyxia and the manner of death as homicide.

If passed, new legislation may change the eligibility of certain counties as venues for cases when a vulnerable adult is financially exploited. Currently, the criminal case must be tried in the county the offense was committed. The bill would also allow such offenses to be aggregated over a six-month period. Passed 122-0 by the House Monday, it now goes to the Senate where Sen. Barb Goodwin (DFL-Columbia Heights) is the sponsor.

    • The American Bar Association has announced a further round of grants to be made in 2013 that will promote and support innovation in the delivery of civil legal aid.  These grants will go to the state Access to Justice Commissions.  The grants will fund projects in seven critical areas of innovation: expanding limited scope representation and other models for affordable services; improving language access and eliminating implicit cultural bias; employing public libraries as point of access for legal aid; enhancing fundraising outside the legal community; creating partnerships with health care and social services providers, government agencies and other new partners; preserving access for low-income people as courts implement e-filing; and increasing web-based delivery of pro bono services for self-represented litigants.  Eligible entities are state Access to Justice Commissions, which are formal entities that bring together the highest level of the state's courts, organized bar, and other stakeholders to support the expansion of access to civil justice for low income and disadvantaged people.  Applications for Grants to Promote the Creation of new Access to Justice Commissions are due by February 15, 2013; applications for Innovation Grants are due on May 1, 2013.

A Southern California man is facing trial for duct taping his elderly mother to a chair and cutting her oxygen tube. The operator of a Sacramento elder-care facility is facing felony charges, including manslaughter, in the gruesome death last year of an 88-year-old resident. The resident, who suffered from dementia and lived at Super Home Care since 2007, died last June after suffering massive, foul-smelling bedsores at the home. The sores on her buttocks resulted in sepsis, a life-threatening condition that occurs when the body develops a severe, toxic response to bacteria or other germs.

Following a two-week trial in Urbana, a jury found that Jacob Graff oversaw a home that "provided worthless services to the residents," and hit him with the stiffest civil penalty it could.

The death of a mentally disabled man in police custody has been ruled a homicide, the Frederick County Sheriff's Office said Friday. The Maryland state medical examiner determined that 26-year-old Robert Saylor of New Market, who had Down syndrome, died of asphyxia last month. A police spokesperson said Saylor died after resisting arrest by three deputies at a the Regal Cinemas Westview Stadium 16 in Frederick. An employee had called police because Saylor wouldn't leave his seat after a movie shortly after 11 p.m. on Jan. 12.

A Tilney All Saints man who stole more than £20,000 from a vulnerable adult over a period of almost three years has been jailed. He had stolen from the man between May 2008 and January 2011 and used the victim’s bank card to withdraw cash for his personal use, as well as online shopping transactions and payments to mobile phone stores, electrical outlets, car breakdown centers and hire shops.
