State and county dignitaries flocked to North Shelby’s Heardmont Senior Center Dec. 10 to show support for new elder abuse legislation. The bill will be introduced in the upcoming legislative session. According to an Alabama Department of Senior Services statement, the proposed bill would create additional criminal penalties for elder abuse, neglect and financial exploitation. Currently, the penalties are found in the Adult Protective Services Act and apply only to victims who are considered “protected.”

An elderly man claims that his adult son assaulted him with a metal garden hose while he was making coffee. A police officer found the elderly man bleeding from his head. The suspect was taken to the Mendocino County Jail and was charged on the suspicion of possession of a dagger, assault with a deadly weapon other than a firearm, and elder or dependent adult abuse resulting in great bodily harm or death. His bail has been set at $50,000.

A former in-home caregiver accused of stealing from her elderly clients is scheduled to be arraigned Thursday morning on numerous theft charges, according to the Fullerton Police Department. The suspect is accused of stealing credit cards, jewelry, identification cards and other account information from multiple clients.

Manager of Marin Elderly Home to be Arraigned on Fraud, Abuse Charges

The manager of an assisted-living facility in Mill Valley who was arrested Wednesday on suspicion of fraud, identity theft and financial elder abuse of a resident is scheduled to be arraigned in Marin County Superior Court on Christmas Eve. The suspect is suspected of defrauding more than $40,000 from an 80-year-old female resident of the 49-bed Marin Terrace assisted-living facility during the last several months. She allegedly stole the elderly woman’s identity, applied and received credit cards in her name and bought retail goods and personal and home items.

A 30-year-old Pasco County woman was arrested Nov. 28 on charges she bilked nearly $25,000 from an elderly man who is suffering from dementia. Authorities say she was a caregiver for the 91-year-old victim, and conducted three fraudulent check and 97 fraudulent debit card transactions. She was charged with exploitation of an elderly/disabled adult.

He also wants to bring his office's case management system out of the dark ages to avoid trial delays and start building a facility to help victims of domestic violence and sexual abuse.

A Letcher County mother and her three children are behind bars tonight accused of abusing a family member. An indictment was returned charging the four with complicity to abuse of an adult and complicity to neglect of an adult. The indictment says they inflicted unreasonable confinement on their grandmother resulting in physical pain and injury. It also says they deprived their grandmother of the services necessary to maintain her health and welfare. All four defendants are charged with one count of neglect and one count of abuse, both are class C felonies.

Woman Charged with Embezzling $140K From Elderly Father

A 31-year-old Redford woman is facing criminal charges after she allegedly used more than $140,000 of her elderly father’s money for her own personal gain.  She was charged earlier this week with one felony count of embezzlement from a vulnerable adult —  a crime punishable by up to 10 years in prison, plus a fine of $15,000 or three times the value of the money or property used or obtained, whichever is greater.

The St. Louis County Police Department is seeking upgraded charges against a South County woman who allegedly beat her 92-year-old grandmother and caused injuries that led to her death. The suspect was originally charged with a felony for first-degree elder abuse. Police say that she threw down her grandmother and stomped on her, breaking her arms and eight ribs because she believed she was a demon.

A Bronx nursing home worker has been indicted after the worker was allegedly caught sexually assaulting an elderly woman with Alzheimer's disease, authorities said. A non-clinical staff member at Hudson Pointe at Riverdale was naked in a laundry closet with the woman, who is in her 80s, when a co-worker opened the closet, nursing home officials said.

A man has been arrested after he allegedly abused and neglected his 104-year-old mother. He has been arrested and charged with abuse or neglect with great bodily injury of a vulnerable adult. The incident report states that a home health nurse called police after she went to the woman’s home and found his mother sitting in her own feces. The woman also had open wounds, which contained maggots.

The Texas Department of Family and Protective Services will use a nearly $1 million federal grant to combat elder abuse and neglect, a problem that a recent study says touched about 11 percent of seniors nationwide in 2010. The $907,000 grant from the U.S. Department of Health and Human Services takes the form of a partnership between Adult Protective Services and the WellMed Charitable Foundation, which will use the money over three years to train staffers in 47 WellMed health clinics across Texas to better identify elder abuse or neglect and develop methods to prevent or stop it.

Teen Charged in Slaying of Developmentally Disabled Man

A 17-year-old boy was charged with the shooting death of a developmentally disabled man in September. On Friday, prosecutors charged Landrain Miller with second degree murder in 38-year-old Timothy Riley’s death. Prosecutors said Miller shot and killed Riley after he refused to hand over the cash in his pocket — $40 he had just earned working as a maintenance man. It was a crime that shocked many in Kansas City.

A new government report highlights the need for better collaboration among federal agencies, banks and state authorities to combat elder financial abuse.  The report by the U.S. Government Accountability Office (GAO) cites estimates that seniors lose at least $2.9 billion a year to financial abuse and exploitation, and that less than a third of cases are reported to authorities. The report exposes gaps in the nation's strategy for preventing and prosecuting elder financial exploitation, including problems in sustaining collaborations between agencies, obtaining data on abuse, and developing expertise in financial exploitation.

In 2011, the Ohio Department of Health cited Ohio nursing homes 198 times for failing to adequately report abuse or neglect, or hiring someone with a history of abusing or neglecting patients. Also, facilities were cited 46 times for failing to keep patients free of “verbal, sexual, physical, and mental abuse, corporal punishment, and involuntary seclusion.” Even in cases where the police do get involved, investigations often don’t lead to criminal charges.

A disturbing case of abuse is caught on camera. The video was released Monday by the family of the victim. The video shows suspects shoving wadded up latex gloves into a 96-year-old woman’s mouth. A 63-year-old disabled man was robbed early this morning while loading groceries into his car at Wal-Mart, according to Rockford police. Police said the man was attacked from behind and fell to the ground. He was punched multiple times while he tried to fight off the assailant, police said.

Woman charged with dependent adult abuse

A Davenport woman has been accused of stealing money and jewelry from victims while working as a certified nursing assistant at a Bettendorf senior facility. She was arrested on Monday on 14 counts of dependent adult abuse. Each charge is a Class D felony that is punishable in Iowa by up to five years in prison upon conviction.

Minnesota AG Proposes vulnerable adult legislation

Minnesota Attorney General Lori Swanson is proposing legislation to better protect vulnerable adults under the care of guardians. It includes an improved background check process for guardians and conservators, and provides stronger financial safeguards for vulnerable adults. The proposed law would require background checks be conducted every two years, instead of every five years as current law requires.

The number of reported cases of abuse against vulnerable adults rose by 23% in just one year, provisional figures show. There were a total of 130,000 cases of abuse reported to 121 councils in the same period. Of these, 108,000 cases were investigated by local authorities, according to provisional figures from the Health and Social Care Information Centre (HSCIC).

State Representative Paul DeMarco and a panel of experts from the Alabama Department of Senior Services and the Alabama Securities Commission, sat down with a room full of senior citizens at an Elder Abuse & Fraud Prevention Town Hall meeting early this afternoon to discuss ongoing fraud trends and provide information on how to spot potential scams. In 2010, the Federal Trade Commission reported that a total of 3,339 complaints of identity theft had been recorded in the state of Alabama alone. Those FTC figures, which equal to approximately 70 complaints per 100,000 residents, rank Alabama at number 15 among the states with the highest rates of identity theft. In 2011, Alabama rose in the ranks to number 12.

Investigators say a 77-year-old woman was supposed to be constantly monitored by nurses at Placerville’s El Dorado Care Center when she died of fecal impaction in 2008 after 13 days in the nursing home.

During a year-long investigation, Watsonville police learned that she had obtained a brand new vehicle and $101,884 in cash from a 78-year-old Watsonville resident. The suspect claims that the vehicle and money were given to her as gifts, but the family of the alleged victim claims that the suspect befriended and manipulated the victim and later took financial advantage of their relationship.

The study claims that compared to accidental injuries, abused individuals were more likely to have severe, repetitive injuries. Access to prior imaging can also be invaluable when determining abuse and because of this, radiologists can play a critical role as sentinel in identifying evidence to piece the picture together.

Daniel Reingold, president and CEO of the Hebrew Home at Riverdale, received a social entrepreneurship award from the Manhattan Institute for Policy Research on Nov. 14 for spearheading the development of a short-term shelter for elder abuse victims. The Hebrew Home’s Harry & Jeanette Weinberg Center for Elder Abuse Prevention has provided shelter, healthcare, counseling, legal aid and other support services for those who are 60 or older since 2005. It is the nation’s first elder abuse shelter, according to the Hebrew Home.

Elderly people who are abused are more likely to have brain, head and neck injuries than those who suffer accidental injuries, according to a new study at the University Health Network in Toronto. The researchers found that the cause of death in one-third of elder abuse cases was subdural hemorrhage, which occurs when blood pools in the space between the outer and middle layers of the covering of the brain. Broken ribs and injuries to the upper extremities, face, teeth, eyes and larynx are also common among abused older people.

While there were 36 accusations of sexual abuse at state-run facilities for the disabled in the past four years, the Office of Protective Services — the specialized police force in charge of the facilities — routinely failed to take the basic steps necessary for a real investigation into the allegations. Most notably, they did not order a single rape kit in any one of the cases in question, even though the kits are “widely regarded as the best way to find evidence of sexual abuse:”

A Chicago mother, because she is quadriplegic, endured an 18-month legal battle to keep custody of her young son. A California woman paid an advance fee to an adoption agency, then was told she might be unfit to adopt because she has cerebral palsy.

An investigation revealed that two mentally challenged people were forced to spend their days outside, regardless of the weather. They were not allowed to eat inside the home or use the bathroom facilities. They were permitted only to sleep.

If a facility’s license is revoked, it can no longer operate. Liberty has appealed; the Ohio Department of Health will conduct a hearing in Columbus on Dec. 5 and 6. Nursing home license revocations are fairly rare. The state moved three times this year to revoke licenses from Ohio nursing homes; it had not revoked any licenses for the previous five years.

A Pleasanton woman, being sought last week as a suspected co-conspirator in an elder abuse and fraud case, turned herself in Friday to authorities, according to police. She self-surrendered to the Hayward Police Department on a charge of criminal conspiracy. Her husband was arrested Thursday  on a warrant for suspicion of fraud, forgery, practicing law without a license and theft of an elderly person’s estate. The assets of the 82-year-old alleged victim are estimated between $750,000 and $1 million and were placed in a trust controlled by the couple.

The Pleasanton Police Department ended a several month long investigation into an elder abuse case reported by Alameda County Adult Protective Services. The victim, an 82-year-old Pleasanton resident and property owner, was being defrauded by the suspects, who allegedly placed the victim’s entire estate into a trust controlled by the suspects. The two suspects are married, and the man is a former Police Commander who was employed by the Pinole Police Department and allegedly used his position of authority to gain the trust of the victim.

Two West Seattle men are facing felony elder abuse charges for allegedly allowing their father to waste away so that they wouldn’t have to spend their future inheritance. When an EMT arrived at the home, she told police she smelled urine and feces in the father’s bedroom and saw the man sitting on the toilet wearing only a t-shirt and socks. The EMT reported that “the socks looked like they had grown into his feet.” Doctors diagnosed the elderly man with dehydration, sepsis, acute renal failure, acute hyperglycemia and altered mental status. He died two weeks later.

In addition, the lawsuit claims, some inmates with disabilities are discriminated against because they are housed in the jail's infirmary, which is equivalent to them being placed in solitary confinement.

A Northern California man has been arrested on suspicion of assault with a deadly weapon and felony elder abuse after he allegedly beat up an 83-year-old man in what police described as a "road rage rampage." A witness told authorities he tried to stop the fight but was assaulted by the same suspect. A second witness also reported being nearly run over by the suspect, who fled the scene in his car. The suspect has been arrested on suspicion of assault with a deadly weapon, burglary, felony elder abuse and battery. The elderly man is in stable condition.

Arrest records reveal that a man accused of attacking a senior citizen in a road rage incident in Rocklin was arrested for battery four days before. He was arrested Saturday for elder abuse, burglary and assault. Rocklin police say he followed the elderly victim to his home Saturday morning where the attack happened.

Police are searching for an Albany caregiver, charged with stealing thousands of dollars from the 86 year old Dougherty County woman she was caring for. Surveillance video from a supermarket shows 46-year-old Patricia Glenn using an 86-year-old woman’s debit card several times to withdraw hundreds of dollars from Prather’s bank account. The total estimated loss is around $7500.

The woman who deemed it acceptable to punish her mentally disabled daughter by forcing her to wear heavy pieces of plywood that said “I am a liar and a theif (sic)” and to help stitch a head wound with a common needle and thread screamed and fell to the floor as the judge sentenced her to 69 months in state prison. Her daughter was found sobbing, wearing pink fur-covered handcuffs, bleeding from the mouth and wearing the large wooden signs. She had been beaten, starved and forced to sleep outside or stand in the hot sun. The victim’s stepfather, who prosecutors say inflicted much of the physical abuse, received 15 years in prison after pleading no contest to several charges.

Financial exploitation by a caretaker is punishable by up to 10 years in prison and a fine of not more than $10,000.

A California nurse has pleaded no contest to felony patient abuse and agreed to help in the prosecution of her nursing home supervisor. The Alzheimer's patient, who was supposed to be constantly monitored, died of fecal impaction in 2008 after 13 days at the nursing home. The two suspects were charged with elder abuse, and also face a special allegation of inflicting great bodily injury, which adds five years to a prison sentence.

A 33-year-old Buhl woman who pleaded guilty to stealing from her 82-year-old roommate has been sentenced to 10 years in prison. Prosecutors say the perpetrator left the victim unable to afford her medications or insurance premiums. The perpetrator was ordered to pay $3,252.21 in restitution.

A Pearl River County couple has been indicted on a charge of exploitation of a vulnerable adult in a case involving a loss of over $100,000. The couple is accused of taking a vulnerable relative's Social Security check, annuity payment and other money over an 18-month period. They each face 10 years in prison.

A new law takes effect November first allowing convicted criminals of offenses such as assault, battery and first degree robbery to work in nursing homes. The law changes what crimes would be considered barriers for employment in the nursing home industry. If seven years have passed since the completion of sentence for assault, battery, indecent exposure, or robbery, a nursing home may consider that individual for employment.

After his daughter left his bills unpaid and helped herself to $20,000 of his money, an elderly man was forced to leave his retirement apartment in New Plymouth where he thought he would spend his last days.  The daughter was sentenced to 300 hours of community work. The judge said he would not make an order for reparation because the daughter, who was on a sickness benefit, had no ability to pay.

A rural Easton woman has been sentenced to 60 days in jail and three years of probation for the mistreatment of a dependent adult at a nursing home. The woman reportedly placed an alarm cord around the neck of a man who was in a wheelchair and threatened to strangle him. She also reportedly pushed the man into his room and closed the door, leaving him unattended. The victim, who suffered from dementia, died about a month after the incident.

The victim has the capacity of a 6-year-old. The woman was found guilty of rape, willful abuse, neglect and exploitation of a vulnerable adult. She could face between 8 and 30 years in prison when she is sentenced.

Another video allegedly shows one man putting the woman’s hand inside his pants. The woman’s daughter has sued the men for elder abuse.

A 98-year-old stroke victim was allegedly the victim of elder abuse after two nurses fondled her during sexual acts. The family suspected that their mother was not being taken care of properly and complaints to AMS Home Care Solutions yielded no solution, so the family set up a surveillance camera. The footage that was obtained by San Diego 6 news was taken between March 3, and March 11, 2011 shows one nurse kissing the woman and fondling her and the other nurse. It also shows them exposing themselves and masturbating reports XETZ.

She agreed to assist the victim by writing checks to the facility, but also wrote checks payable to herself.

What could have been a tragedy for a Clinton family who reported their elderly relative missing during the height of the Nor'easter Nov. 7, turned out to have a much happier ending than anticipated. Several hours after the Silver Alert was issued, or about 9 p.m. on the evening of Nov. 7, the Clinton Police located the man at his home.

A 45-year-old Fresno woman was arrested earlier this week for 200-counts of theft and burglary involving seniors. She is also accused of using personal information to steal money from the elderly. Clovis Adult Education is offering a special class this fall to show people how to recognize and prevent elder abuse.

A Napa man and woman were arrested Sunday afternoon on suspicion of elder abuse and battery inflicting serious bodily injury, according to an arrest summary from the City of Napa Police Department. The couple allegedly got into an argument with an elderly person, and it became physical. The two suspects are accused of striking the victim, causing injury.

A Southern California woman facing trial for animal cruelty is now charged with elder abuse for leaving her ailing 86-year-old mother outside on a chaise lounge for days. Investigators say the elderly woman was soaked in urine, covered with feces and had bleeding bedsores when she was brought to an Orange County hospital last month. The woman’s daughter will be arraigned on Nov. 29 for causing great bodily injury on an elderly person.

The S.A.F.E., Seniors Against Financial Exploitation, seminar was sponsored by Catholic Charities, Stanislaus Elder Abuse Prevention Alliance, WestAmerica Bank, The Congress of California Seniors, Walgreens and Verizon Foundation. Walgreens was on hand to provide flu shots and many area agencies and businesses had tables and displays set up to offer information. A series of speakers also touched on topics of concern to an aging population, ranging from elder abuse to financial issues.

A Watsonville man and his girlfriend were convicted this week on misdemeanor elder abuse charges, following a two week jury trial. However, the jury returned not guilty verdicts on felony charges. The victim testified that his son had slapped him, punched him in the abdomen, wrenched his arm behind his back, and called him profane names. He also said that his son’s girlfriend slapped him, grabbed his face and pulled his ears while calling him profane names. The victim passed away 13 days after giving his videotaped testimony.

A Gainesville nursing home employee has been arrested, accused of slapping the head of a dementia patient who recently had brain surgery, according to a Gainesville Police Department arrest report. The victim, who is unable to control the use of his arms and legs and is either in bed or in a wheelchair, began flailing his arms and legs, trying to stand up. The suspect allegedly pushed him back into the wheelchair and hit him in the back of the head with an open hand.

Golden Age Skilled Nursing and Rehab, the nursing home that was recently fined $8,000 by the Iowa Department of Inspections and Appeals – Health Facilities Division for failing to help a dying woman, has a long history of citations and violations. According to records made available from the Iowa Department of Inspections and Appeals website, and compiled by the Daily Iowegian, the Golden Age has received $56,675.50 in fines and 123 violations since Dec. 3, 1999, the date of the first record available online.

 An Iowa nursing home has been fined $500 for not reporting possible sexual exploitation of a resident by a home employee. The worker was accused of kissing the resident and having other sexual contact with him. The home administrator fired the workers, and told inspectors that she didn’t report the matter to the state because the relationship was consensual. Iowa law says that any consensual or nonconsensual sexual conduct between a patient and a caregiver must be reported to the state as abuse.

For 11 years, a man with a criminal history of burglary, forgery, arson, and criminal possession of stolen property told lie after lie to a 91-year-old Catholic priest, swindling him out of more than $500,000. The perpetrator pleaded guilty to third-degree grand larceny, and faces seven years in prison when he is sentenced Dec. 12. Prosecutors could have pressed a higher felony charge against the thief, but the cleric was reluctant to testify, and is embarrassed and humiliated by what happened.

The husband of a 400-pound Detroit-area woman has been charged with abuse after her recent death. Authorities are accusing the suspect of allowing his wife to fester in a bed surrounded by her own waste. The 40-year-old Warren woman died of morbid obesity and other injuries last week. The suspect is charged with second-degree abuse of a vulnerable adult.

  • The Johnson Controls Foundation announced program grants to support education, health and hospitals, community funds, social services, including aid to the handicapped, care of children, and the aged; and civic, arts, and cultural organizations.  Johnson Controls tends to focus in areas where they have a presence, but will fund on a national basis. Extra consideration is given to organizations or institutions in which Johnson Controls employees are involved and are contributing their time and/or money.  Funds can be applied to annual campaigns, building/renovation (bricks and mortar), capital campaigns, continuing support, emergency funds employee matching gifts, employee-related scholarships, general/operating support, matching/challenge support, and seed money.  The Foundation distributed $6.7 million in grants in 2011.  Funding is limited to nonprofits.

  • Cisco and TechSoup: Applications to receive donations of Cisco networking-solutions software, through a program sponsored by Cisco and TechSoup.
